This lady came to the shop on the 0 1113114 asking for used tires for her car. After checking the size of the tires on the car, I told her that I do not have the size she is asking for. What I do have is 235/55119. I took her into the shop and presented to her what I had. Then she said no she...
would not get them. Then she left the shop. I do not know where she went to; she came back later that I should put on the tires. I gave her the ones she selected from the size I had. She paid $ 120.00 for the tires and I issued her a receipt for that which she signed on it. Before installing a tire on a customer 's car we call on his/her consent regarding size and price before the tire is installed. I was shocked when she presented herself at the shop six months later stating that the tires I installed on her car, with her consent had caused damage on her car totaling 2,562.36 dollars.
I unequivocally deny her claim as being baseless and without merits. The damage to her car was not caused by tires she bought and used six months earlier. Additionally the installed tires were selected by her and she knew what she was getting. Furthermore, there is no causal connection between the tires installed and the damage alleged. I also want to emphasize the fact that this a deliberate attempt by complainant to defraud us and
we respectfully ask that you deny and reject her request. She has failed to prove the fact that her damage is a direct or proximate of the tires installed . We deny her claim as being unsubstantiated.
Furthermore, Complainant states in her complaint that the transfer repair box had been fixed once and that the inspector told her the tires caused the problem. She never told us and should have replaced the tires. She has failed to explain why the problem occurred a second time if she knew that the wrong tires caused the box to be defective before. She has failed to explain why she continued using the tires if at all she did. She has not established that the damage to her car was caused by tires that she bought from our store. Please dismiss this baseless claim
