May 27, 2016Dear [redacted]:This letter is in follow up to our telephone conversation of Friday, May 20, 2016.During our conversation you requested PeoplesBank, retract the late payments we reported to the Credit Bureau under the above referenced loan. you shared you had not received any...
notifications of payment due, you were unsuccessful in gaining access to your loan information via internet banking to verify the amount due and that you were told on several occasions, by members of our Nottingham branch that you could not have your payments automatically withdrawn from another bank account with a different Financial Institution. Due to these issues you felt that the payments received late were not a result of your efforts to pay on time. Upon investigating your loan, I used the following documents:o The original Credit Agreement and Disclosure that you and [redacted] signed on August 18, 2006. This disclosure provides your address, the amount of the loan, the terms of the loan repayment, the inception date of 8/15/2006 with a maturity date of the final payment 8/15/2031. This document also shared that you would have monthly installments due starting in August 2006 and would not conclude until your last payment of August 15, 2031. This would contradict you comment of not knowing a payment was due.o A spreadsheet was created from your billing and payment history which displays the 17 late payments received and therefore reported to the credit bureau. The items in red reflect a payment received 30 days after the due date. As you will see you have made late payments as far back as July 20, 2009 and have made several late payments in 2010, 2011, 2014, 2015 and 2016, showing a pattern of late payments throughout. o Enclosed are duplicate copies of monthly statements sent to your current address. These notices are generated approximately the 24th of each month showing a payment due date always on the 20th of the following month. These notices have been generated since the inception of your loan in 2006 and to date we have not received a one back from the U.S. Postal Service as "undeliverable"o you indicated that you were not successful in being able to view your loan information through internet banking due to a dormant status. According to our records [redacted] first signed up for on line banking December 29, 2006. She then again signed up July 21, 2010 as the account was not utilized until April 16, 2014 and a dormant status went into effect after 90 days of no activity, [redacted] attempted again to go online on April 22, 2016 and May 2, 2016 at which time her attempts failed. However we have no record of her calling into PeoplesBank on either one of those days to question why. On May 4th, 2016 we received a call and reset [redacted]'s internet banking advising she must sign-on within 24 hours or the dormant status would go back in place. We show no attempts of her signing on. On May 9, 2016 we received another call from [redacted] requesting we unlock her, at which time we did explaining again she must sign-on within 24 hours or the dormant status would go back into place. To date [redacted] has not tried to go into internet banking.o According to our records we show [redacted] contacted our office on the following dates for various pieces of information; o 6/5/15 - called in for rates o 8/4/15 - called for internet access o 4/22/16 - called in for rates o 5/4/16 - called in for rates o 5/9/16 - called in with regards to late charges on account o 5/12/16 - called in for rateso According to our records we show [redacted] called in on May 9, 2016 asking about the April and May payments, advised he did not get any bills and was upset about the inability to do auto deduct for payment.o I spoke with Michael on Friday, May 20th at which time he expressed his displeasure with our service and our inability to service him. I had the appropriate forms sent to him to have his loan payments auto deducted and spoke with the Nottingham branch to explain how our process works.o The associate who provided incorrect information to [redacted] has been coached on the proper procedure to have payments auto deducted from a customer account at another financial institution.Based on these findings, we did report your late payments correctly and therefore are not in a position to retract our recording,Sincerely,Lori B. Regarding the above referenced complaint, I offer the following response:Client did attempt an ATM withdrawal at our Dover financial center on Thursday, April 14th. While waiting for the transaction to be completed, video surveillance shows that client was occupied using a cellphone. It appears that...
client did not retrieve the cash in the time allotted and the cash was withdrawn back into the ATM. There appeared to be a misunderstanding with Bank employees regarding the balancing of the ATM, which needed to be completed in order to substantiate the client’s claim that she didn’t receive the cash. Once the misunderstanding was cleared up, the client was given the cash the same day.Should you have any questions or need any further information, please let me know.Sincerely,Todd A. appears that client did not retrieve the cash in the time allotted and the cash was withdrawn back into the ATM. 1st. We did not realize that the frame was bent until after the second attempt to put the replacement screen on. 2nd. We have offered to fix it after learning that it did not hold. 3rd. We will not give any kind of refund until the phone is brought back so we can remove the...
screen. [redacted], [redacted], [redacted], and other don't give refunds unless the item is brought back. I don't understand why we would be expected to refund just because. 4th The screen must be in working order and be on the same cosmetic condition upon Wichita it was received.

I am rejecting this response because: It was not just an email conversation, but also a phone conversation. I have attached my phone record so you can see this as well. The email is to show you proof that we started the conversation of selling the home because when I first discovered the lease was renewed against my will in August you told me that you had no records in my file. This issue here is your employee who is acting as our agent has not been documenting conversations and updating the file as promised and instructed. After the email three days later we had a phone conversation where she said she would have the real estate agent reach out to us to see our options before the next lease renewal which at the time I believed was October not August. As you can see in the email I thought the home was supposed to be leased until October which is why I was very shocked to see the renewal in the August bill for you acting as my agents for my property.Your very own real estate agent advised against selling the property because the fact that it is leased and would only appeal to investors at this point and it would cost us at least 15k to sell it now as opposed to sell itnow with out a lease on it. This is not an issue of goodwill this is an issue of damages.

Do not get a commercial loan working with [redacted]. Biggest jerk I have ever had to work with. He is condescending, rude, and has no clue how to manage a loan. He has horrible people skills
