This email is in response to Consumer Complaint #***
Ms*** was referred to *** Fitness after contacting one of our subcontractors Mr***Ms *** attended a free Semi-Private training sessions on 6/28/after communicating with Mr***
that she would like to try his 5am Semi-Private training sessionMs*** was informed of the studios prices for Semi-Private training by Mr***Ms*** then attended her second unpaid workout after communicating with Mr*** on 6/30/After her second training session paid for a package of sessions for $dollars and signed our studio agreement policy which was received by our studio manager *** ***This was the first contact Mr*** had with Ms***Mr*** in no way convinced Ms*** to give him $dollars as the services being offered are voluntary and Mr*** did not speak with Ms*** prior to her willing participation in training sessions that were unpaid forIn no way did Mr*** steal Ms*** moneyMs***s account is still active and she is more then welcome to attend any Semi-Private training session that *** Fitness offers at any of the times spots weeklyMs*** was informed we have a scheduling software that we use at *** Fitness, called Mind BodyMind Body is the number one used scheduling software for private training studios*** Fitness is an appointment based business and not a "Gym" that can be used at any given time*** Fitness currently has plus members using this software to schedule their training appointments, most of which use a cell phone application to do so*** Fitness scheduling system can also easily be accessed online with any computerMs*** struggled to understand how to create a profile and log inMr*** only communicated with Ms*** through text message, as Ms*** was unavailable to communicate over the phone, or in person through numerous failed attempts to reach her or have her come into the studioMr*** communicated with Ms*** on July 6th times, July 7th times, July 11th time, July 18th times, through text message, every time either to help Ms*** log into our software or to schedule Ms*** for the sessions she would like to attendMs*** contacted Mr*** on July 21st requesting a refund due to her Jeep braking downOn July 22nd Ms*** text Mr*** asking him to disregard her requestOn July 25th Mr*** offered to come in on his day off at 5:00am to walk Ms*** through the process of logging into or scheduling softwareMs*** did not show up for this training sessions or appointment with Mr***On 7/26/Ms*** again text messaged Mr*** informing him that she had misunderstood her transportation and that she wanted to attend Thursdays mornings classMs*** was informed that Mr*** would not be instructing classes at that time due to personal matters and was offered the option of a refundMs*** excepted the offer a refundMr*** was able to continue instructing his 5am sessions and after Ms*** received word of this she again text Mr*** again changing her mind and asking that she be able to complete her sessions rather then receive a refund and that she would be attending the following days sessions on 7/29/Mr*** came in early again on 7/29/to help Ms*** log in to our scheduling systemOnce again Ms*** failed to attend her training sessionOn 8/3/Ms*** once again text messaged Mr*** requesting a refundMr*** offered a refund that is not required of him as our studio policy agreement states no refundsAt this time Mr*** was doing everything he could to satisfy the customerOn 8/5/Mr *** messaged Ms*** informing her that we would no longer be offering her a refund for her unused sessions due to a negative, misleading and dishonest yelp reviewMr*** tried many times to resolve the issues Ms*** was havingMs*** felt it necessary to use Mr***s' name in her review and her perceived lack of help, although Mr*** only had actual interaction with Ms*** for roughly minutes on 6/30/Mr*** had a total of text message exchanges back and forth with Ms*** to resolve her scheduling issuesMr*** made phone calls that went unanswered by Ms***Mr*** came into the training studio on separate occasions at 5am on his days off to help Ms*** resolve her scheduling issues, both times Ms*** did not show up for her appointmentsThis was Mr***s first negative yelp review in more then years as a personal trainer and as our studio managerMr*** never actually trained or worked with Ms***It is not *** Fitness policy to offer refundsMs***s sessions are still validAlso our scheduling software shows that Ms*** was able to log in and sign up on her own for a Semi Private training sessions on 7/25/at 8:02pmMs***s claim that she was unable to sign up is falseMs***s claim that she could not sign up using her phone is falseMs***s claim that Mr*** did not try to help her resolve her issues is falseMs***s claim that she did not sign up for any classes is falseMs***s claim that her review of our business was complimentary is falseMs*** claim that Mr*** stole her money is falseMs*** claim that Mr*** refused to help Ms*** is falseMs*** claim that Mr*** convinced her to give him $dollars is falseMs*** is welcome to attend any of the Semi Private training sessions we offer weekly until her session expire on 6/30/
