In response to Mr***’s complaint: Our representative did sign his estimate that was given to Mr***. There was some back and forth on pricing and there was some human error by our representative in measuring the roof. Before we put the project into production, we
ordered a satellite measurement to double check the measurements, which uncovered the error that was made. We then notified Mr*** that a mistake was made and the roof was larger than originally measured, therefore we could not start his project (re-roof with a special order shingle and re-deck, windows, and all gutters) for the price previously discussed with him. We told him the project would take an additional $4,if he still wanted us to start the project (not a phone call that we wanted to make knowing we may lose the contract). He did not seem to understand or believe that we were being honest upfront rather than starting the project and attempting to get more money in the end (a practice that we avoid). He proceeded to tell us that his insurance was going to lapse in March (we assume due to the lack of repairs from the insurance claim in May of 2015) and we are at fault now if he doesn’t get a roof installed before the lapse in his insurance coverage. Mr*** originally contacted us for an estimate on January 1, and our last conversation regarding the estimate was February 24, We told him that our contracts are subject to management approval and that’s when he stated that he did not receive the terms and conditions on the back of the estimate/contract (although his signature is just above the statement: “Customer has read and agrees to all terms and conditions on the back of this Agreement.”). At that time, we emailed him a copy of the terms and conditionsWe did not encourage Mr*** to sue us, rather he stated that he would sue us and send us the bill from the new roofing company that he hires. We told him that if the other companies that he received estimates from (supposedly hirer that our original estimate) would stand behind their price, that we’re certain that they would be happy to take his money. He replied: “No, they have already moved on”We did not provide any materials or any services beyond the estimate(s) that were given.
