Review: Park Run Management operates [redacted] Apartments in [redacted], PA. My vehicle was towed from the parking lot of the [redacted] apartments while the operator was a guest of a tenant of the apartment complex. The towing company informed us that [redacted] management authorized the towing, after the car had been observed to lack a current registration sticker. Neither the towing company, nor the apartment manager([redacted]) verified whether the car was properly registered at the time of towing. The vehicle was, in fact, being operated under a valid temporary registration. The towing company failed to properly notify the jurisdictional police that a car was towed from the apartment complex, so when the vehicle was discovered missing jurisdictional police ([redacted], PA) were summoned and a stolen vehicle report was filed. Subsequently it was determined that the car was towed from the premises under contract with the Apartment Complex. Police informed us that the Apartment Complex lacks proper signage to allow legal towing from property. The Apartment Complex manager failed to ascertain registration status when authorizing vehicle for towing by the Towing Company. Apartment Complex manager, [redacted], and subsequently Apartment Management treasurer, **. [redacted], failed to accept financial responsibility for improperly authorizing the towing services of a vehicle which was operating under a valid temporary registration, and which vehicle was parked with the permission of a tenant of the complex. The towing company subsequently towed, impounded, and stored the vehicle... refusing to release the vehicle until towing and storage fees of $260.00 were paid in cash. The fees were paid under protest, and only after Park Run management refused to accept financial responsibility for erroneously authorizing the towing services.Desired Settlement: I would expect the Apartment Management Company and/or the Towing company to fully reimburse me for Towing fee of $120.00, Storage Fees of $140.00, and mileage for 2 round trips to area involving apprixamately 270 miles of travel valued at $148.50. Total value of reimbursement should be $408.50.

March 17, 2014One day in March 20141 received a call that someone had his or her [redacted] towed out of our parking lot. I don't like when that happens so that same day 1 returned the call to the individual after speaking with the Property Manager and the towing company about this incident. I found out that guest had left their car in the parking lot for over one week with an expired registration sticker as per the towing company stated. Neither the resident or the guest informed the leasing office that the car was going to be parked in the lot while they went on Spring Break. When you drive in the parking lots there are signs provided by the towing company and all residents are informed when they move in that a towing company monitors the parking lots. The car was stickered by the towing company giving 48 hours of notice before the towing company towed the car. The towing company informed the proper local authorities before initiating the tow. If either the resident or the guest would of asked for permission from the leasing office then this tow would have never taken place. I even asked the towing company to work with the individuals whose car got towed and give them some break on the costs but they refused because of rude manner in which the owner of the [redacted] spoke to them on the phone. It’s important when parking your car on private property to notify the proper authorities to avoid parking tickets and towing expenses.

I am rejecting this response because:In
the response from Park Run Management, **. [redacted] seems to have been
misinformed as to some of the facts involved in this complaint. First, my car
had not been left in the parking lot for over a week. Second, my car was being
operated with a valid temporary registration. The [redacted] property
manager authorized the towing of my vehicle without consulting with the
jurisdictional Police to determine whether the car should be considered as
abandoned property under Pennsylvania Department of Motor Vehicle code. I
have attached a fact sheet which outlines the process involving a private
property owner lawfully removing an abandoned vehicle from their property. The
3 methods of removal offered by the State DMV code would have protected my
rights as well as the rights of the property owner. Sadly, the process chosen
by the property owner, in conjunction with the contracted towing company [redacted] ([redacted]),
did not take into account that I had not requested, desired, nor expected my
car to be towed from the location where it was parked with permission from a
lease-holding tenant of the apartment complex. I was denied the rights and
privileges of due process under the law because...
