Paradox Solid Surface

My familys home sustained extensive damage resulting from a fire on 2/2/13. Based on the amount of our insurance settlement, we hired [redacted], owner of said business, to restore our house back to the way it was as well as implement some upgrades. He gave us projected dates of completion and a payment schedule. We promptly paid invoices for deposits and payments throughout the process, yet he failed to meet four different completion dates spanning June to November.On Nov 25, [redacted] presented us with an invoice amounting to slightly over our settlement budget. We met with him to discuss the imbalance of funds paid (90%) relative to work completed (around 50%), stating we were not comfortable making additional payments without reassurances of a move in date. Ultimately, we gave him half the invoice he presented with an agreement he would continue. The following week, [redacted] decided to walk off the job until the balance of the invoice was payed, we agreed to pay if he would sign an agreement with a firm completion date. He refused. Furthermore, he refused our request to return the unused portion of the deposits we have made and/or materials purchased with those funds. We are currently left with a house that is uninhabitable and no money to hire another contractor to complete the job.Desired SettlementWe would like the contractor to refund us the unused portion of the [redacted] an estimate of [redacted] In addition, return all materials that he has bought with our money to our home including paint, radiant floor pads, cabinets, and our dining room chair that was used to determine stain for our cabinets he built for our kitchen.
