After a 3 month lease, apartment 301 was vacated and I paid $125 to have the unit professionally cleaned. When I received a letter from the apartment complex saying that not only would the security deposit be lost, we owed another $250 for damage, I was quite shocked. After several attempts trying to speak with the manager, I finally received an email with pictures of the damage. The pictures showed indentations in the vinyl den floor from where a Lazy Boy couch and chair were placed. There was no intentional damage and the indentations should be considered as normal wear and tear per the legal definition. I emailed the manager and said that it was normal wear and tear and it would not be the tenants fault if the complex chooses to use vinyl flooring in a den that can't handle the weight of a couch and chair. They would not budge at all and are also charging me for carpet cleaning as well despite the fact that I had the carpet and unit cleaned after vacating. I have the pictures they presented and I can also provide pictures of the furniture with legs that exactly match the indentations referred to as damage instead of the legal normal wear and tear.

I am writing in response to the complaint about the move out charges for apartment 301. The vinyl in the apartment was brand new when they moved in. After the resident moved out the vinyl was torn and damaged. There were visible signs where furniture was dragged on the flooring causing the damage. We pass on the charges for the damages to the resident. The carpet cleaning charge is a standard charge for all residents moving out. This is told to the resident at the time of move in. At the time of the move out inspection , we had not proof that the carpet had been professionally cleaned and did find the condition to require a cleaning by our carpet contractor.
