Jack has always been fair with my family. We have bought 3 boats from him since he's been in business and sent a lot of business to him over the years too! Pacific Marine Center is the best!
On 08/13/2018 I recieved this email from Pacific Marine Center, "Due to the disparaging reviews you left on the internet we are not interested in doing business with you at this time." Since then, I have not received my $5000 deposit I placed for the purchase of a boat on 05/30/2018. Nor have I taken delivery of any boat from their business.
California’s Assembly Bill 2365 makes it illegal for companies to penalize customers who voice their negative opinions online. The Consumer Review Fairness Act (CRFA) also protects people’s ability to share their honest opinions about a business’s products, services, or conduct, in any forum, including social media.
Here is the copy of the review I left on Yelp and Google about my terrible experinece with Pacific Marine Center two months ago:
"This is the worst experience I've ever had purchasing any watercraft or vehicle from any dealership! In May 2018 I was interested in purchasing a new boat for this summer. I called Pacific Marine Center and explained to *** (the owner) that I needed this boat by the end of June at the latest. I explained to him that if he cannot guarantee that the boat will be here in time that I would not be placing the order. He reassured me over the phone that if I came down and placed the order the next day, it would be arrive by the 3rd or 4th week of June. The next day (May 30, 2018) I drive four hours to this dealership to place my order. I also put down a $5000 deposit. June passed and I did not hear anything from this dealership. I called and asked for an update and was told that it would be another few weeks before it arrives. Basically it would arrive at the middle/end of July. About a month later than promised. I informed the dealership that I would like to cancel my order and get my deposit back, since it would be available a month later than I promised. *** the owner started yelling at me over the phone that he never told me that the boat would be ready to "pickup" at the end of June. But rather that the boat would be "completed by the manufacturer" at the end of June. Either case, neither was true. As of July 5th, the boat is still not completed and it would take another few weeks to arrive at the dealership. But I assure you that I triple checked with him over the phone that boat would be ready for PICKUP at the end of June before I drove 4 hours to place this order back in May. *** told me he would not be giving my $5000 deposit back. I honestly believe he promised me that it would be ready for pickup at the end of June just to get the sale, even though he knew it would not arrive in time. What a shady business! *** even threatened to file a lawsuit on me for wanting to cancel this purchase and receive a refund on my deposit! I've never seen or heard any dealership threaten to file a lawsuit on a potential customer for not wanting to do business with them anymore. It gets worse! He then told me that once the boat arrives he would charge me an interest of 13% each day the boat sits at his lot and not paid for by me. This is after I told him that I no longer want to do business with his company. This has been a nightmare and I would strongly urge anyone thinking of purchasing watercraft from this company to go elsewhere."
Mr. ***y ordered a special-order boat from us
on May 30, 2018. He came into our store
that day went over colors and options that he wanted specifically for his
boat. Once that was all completed we
wrote up a purchase agreement, he gave a $5000 deposit and both parties signed
the purchase agreement. On that purchase
agreement that he did sign states that “all special-order boat, engine or
trailer deposits are non-refundable. “
On May 30, 2018 *** turned in the order for his boat. Early morning May 31, 2018 I received an
email for us to clarify and confirm order.
June 12, 2018 we sent to the manufacture the requested 20% deposit for
this boat of $8799. We pay the
remaining balance when boats are delivered to us.
Mr.y claims that *** stated that his boat would
be delivered in one- months’ time. ***
did tell him that the boat manufacture would have it completed in approximately
4 weeks and then they have to deliver it from Michigan which has about a 1-week
drive. The boat was completed in the
correct time frame. However, if ***
truly believed this boat was do be delivered at the end of June 2018, then why
did he call me on June 27, 2018 to make changes to his boat? In the complaint he wrote to you, he states
that June passed, and he heard nothing from us.
That is false.
We told him his boat was being put on a boat load on
7-2-18. Keep in mind boats can only ship
on a truck load not single boats, we had to purchase 2 other boats that we did
not need to get his boat here. Now on
July 2, 2018 he still has not talked about backing out of this deal, he asked
about financing which he did not even have in place, so he could take
possession on the boat. He used our
broker and on July 3, 2018 our broker stated that they were having a hard time
getting him approved thru our banks we are signed up with thru the broker. They had only one bank that approved him and
it was for a high rate that *** was not happy with.
On July 6, 2018 *** called our dealership and stated that
he did not want the boat any longer and to refund his deposit. *** told him that it was a special-order boat
that is also in transit to us and the deposit is not refundable. At that point is when *** told *** that he
had promised him the boat in one month and did not deliver that promise and
that was his reason for cancelling. ***
told him he did not promise him that it would be delivered in one-month
time. Again, if that really was his
reasoning for canceling why try to make boat changes in end of June and then
apply for financing in early July? We
believe that he just wanted to cancel when he discovered that he could not
obtain financing at the rate he wanted.
During that phone conversation he threaten *** that if he did not give
him back his deposit he would have him, and his friends write bad reviews to
hurt our business. He did in fact to
that within 1 hour of the conversation.
I have emails of those reviews. *** was on speaker phone during this
conversation from when he called, which he was made aware and *** and ***
were present in this conversation.
*** stated in the complaint to you that as of July 5th
the boat was not completed, and it would take another few weeks, which is not
true, I have the emails to back up such information.
We notified *** that his boat had arrived July 10, 2018 and
he was given to the end of the week to see what he wanted to do. He called our broker that day and he was
going to try to work on fixing his credit to see if he can get a better rate or
at least another approval from a bank.
In the complaint to you he also states that *** threaten to
file a lawsuit for wanting to cancel his purchase, it is true that *** said he
would file a law suit if he did all those bad reviews, which *** did do, but
not for cancelling the boat deal. ***
has also stated that he was going to sue us if we did not return the deposit,
but *** told him on the phone that his deposit was nonrefundable. We did ask *** to remove the bad reviews
especially since we were moving forward with him to finalize the purchase of
his boat. He never removed the reviews
and therefore, we did file a lawsuit for defamation. We were informed by our attorney that ***
was not answering his door for the servers.
So at that point is why an email was sent to *** August 13, 2018 stating
“due to the disparaging reviews you left on the internet we are not interested
in doing business with you at this time.”
It was not realized when that email was sent that he was
trying to secure his financing with his own bank, I emailed him right back and
stated please continue to do your financing.
But the next day he stated that he canceled his loan process. I also emailed him that it was always our
intent to sell him this boat that he ordered but remove the many bad reviews so
we can move forward.
In his complaint to you he stated that the consumer review
fairness act protects people’s ability to share their honest opinions about a
business. That we can understand, but he
did not just write one review of this honest opinion, he fabricated other names
and wrote very “dishonest” reviews that had nothing to do with us. I even contacted Google business to attempt
to get the fabricated ones removed as you could tell they were not true as they
all took place same day within hours apart of each other.
The customer complaint is to have his deposit refunded,
however his deposit is not refundable. We
have his boat here still in shrink wrap, that we cannot sell or will have a
hard time selling as it has options and colors that are not typical of how we
order them, it was to *** Posternasky specifications. Nor can we return this boat to the
manufacture.

I am rejecting this response because:Sorry too late, we are at the end of September now and you finally decide to show me the boat? You should have shown it to me months ago when I requested to see pictures. If I don't see a check in the mail for the amount of $5000 (my deposit) in the next 5 business days, I will be sharing my experience with 100 more friends and family members.
