            Re:      ----, Wilmington Delaware 19803   Dear Ms. [redacted]:           This will confirm our June 26, 2016 discussion wherein we discussed your complaint relative to a drainage issue near your garage and your request to have my billing reduced due to same.  I would like to address these issues in writing so we are both clear on the matter.    With regard to my billing in the amount of $9,022.40, I was contracted by you for “paving” work detailed in my invoice which you received.  Although the work contracted for was completed, you issued payment to me of $2,000 which leaves a balance of $7,022.40.  Your reason for the difference in payment was due to your dissatisfaction with the paving work done on the property.  You insist that my work resulted in water collecting and entering your garage.   Relative to your complaints related to the leakage into the garage, I returned to your property not once but three times to address your concerns.   As I explained to you the drainage issue is caused by concrete skirting sinking and not with the paving of the driveway.  The concrete issue was not mentioned prior to the contract of paving and, therefore, was not part of the contracted services.               Although it does not appear that there will be a working relationship between you and I in the future, I am sure you will understand that, based on the terms of the contract, the balance of $7,022.40 is due and owing.  In an effort to resolve these matters quickly and amicably, I am willing to accept an additional $3,511.20 as full and final payment.  If payment in full is not received on or before August 1, 2016, I will have no option but to contact my attorney to enforce collection of the full invoice submitted to you along with attorney’s fees and costs.               It is unfortunate that you have chosen to place the blame for your concrete problem on my company.  If I had been apprised of the leakage problem prior to contracting for the job, I would have explained to you that the concrete leakage was its own problem and installing the asphalt would not have fixed your original problem without also repairing the concrete skirting.                                     Very truly yours,                                                 ...⇄ RICHARD DONAHUE
