I downgraded my membership in May 2017 to ($69). They continued to bill me unlimited membership ($169) for 10 months. They have been contacted multiple times in person and on the phone about the discrepency in billing and have not refunded me the difference. They owe me over $800. They are aware of the mistake they made and have not rectified the issue.
I signed up for a Premier month to month agreement back in July at a cost of $169 per month. I went twice and realized that it was too far. I called on September 26th to cancel the membership and was told that I had to physically come in to cancel and fill out a form. I asked that the form be emailed or faxed to me and was told that was not an option. I asked to have the manager call me. I called and left a message on the 29th and finally heard back from CT on the 3rd at which time he told me that he needed to speak with corporate for approval. He called me back on the 10th and left a message. I called him back on the 12th and was told he was out West. I called again 4 more times over the next week and have yet to hear back from him. I am looking for a refund for October and a cancellation confirmation as they tried to bill my card for November.
I have received the complaint filed by *** by mail. The ID is *** for reference. I have attached the response from Orangetheory Fitness Totowa to this email in PDF form, along with evidence of her account and the contract that she signed with us. Please let me know if there is anything else that we can provide you with.

I am rejecting this response because:
The agreement was signed and witnessed by Kaila M who can also attest to the cancellation policy as explained by the Orangetheory rep and at no time did she state that I had to come in person to cancel. She stated that you needed to give 30 days notice of which I have attempted to do many times. This was to be a month to month membership with a 30 day cancellation policy of which I have given verbally on several occasions.
There is no reason that they cannot email or fax a cancellation form and it is unreasonable to expect clients to physically come into their store to cancel the agreement. At the time of cancelling the membership at the end of September, I was not physically able to come into the store and have no problem providing a Doctors note to confirm.
