[redacted] and [redacted] moved into [redacted]on October 24, 2014. Mr. [redacted] signed the move in inspection on October 24, 2015 acknowledging the carpet was new throughout the apartment and there was new vinyl in the bathrooms and kitchen. Upon move out...
estimates were obtained reporting pet damage and bleach to the carpet which had to be replaced. In addition walls were heavily marked and stained with grease, resulting in tenant charges. The $200 security deposit was credited to the account and Ms. [redacted] and Mr. [redacted] were sent a Final Account Statement (Exhibit #1) to the apartment address, as they left no forwarding. Upon contacting Colony Management Ms. [redacted] gave her address and signed a Payment Arrangement agreement with the Accounts Manager, Marie R[redacted] on October 26, 2015. (Exhibit 1A) Payment was also made to the account at that time in the amount of $262.83 via money order and credited to the balance. (Exhibit #2 and #2A) This left a balance on the account of $800.00 as stated and agreed by Ms. [redacted] in her complaint. No other payments have been received from Ms. [redacted], nor has she presented any receipts of payment or where the alleged $100 money order payment was purchased. On January 5, 2016 Mr. [redacted] submitted a money order in the amount of $100.00 (Exhibit #4) which was credited to the account the next business day January 6, 2016. To date the new balance is $700.00. As stated in the signed Payment Arrangement form, if payment in not received the account will be sent to the attorney's office for collection with additional fees and interest added. Payment of $318.87 will be due by February 5, 2016 to avoid having this account turned over for collection. If payment is made we will gladly resume working with Ms. [redacted] and Mr. [redacted] to satisfy their outstanding balance and to keep them from incurring unnecessary attorney fees and court costs.
