We were not notified of our insureds passing until [redacted] contacted [redacted] to inform us that the house has sold The deed on file at the court house, taxes, mortgages are all still listed in the name of our insured's [redacted] Company practices are to process refunds for our listed insured only, as heirs or trustees are legally able to negotiate the proceeds with the proper paperwork.At the time [redacted] contacted our office, she was instructed to present the refund check to the bank with the proper paper work The bank called while she was present asking for [redacted] to approve payment to just her as the other heirs were not present There are other heirs listed on the beneficiary deed, that was in [redacted] possession, but not filed with the court house, therefore the bank, nor our company would approve a payment to just one heir, [redacted] [redacted] Mutual has no desire to "keep the money" as alleged in her complaint, however, we have a duty to protect our insured and consequently ALL heirs when we process a refund Normally, this situation is a moot point because the transfer of title, mortgage responsibility and consequently insurable interest is transferred in a timely manner after an all insured are deceased [redacted] 's inability to negotiate the check as written, ton the insured (or estate of; in some cases) is due to the time frame since the death of the heirs; no bank account exists now that the check can be deposited in, and [redacted] is not the sole heir and does not posses or hasn't presented any paperwork awarding her ultimate decision making rights with the estate The bank expressed a reluctance to honor a check presented in the future with all of the heirs listed as they would not have a way to verify the signatures of all heirs unless they were present [redacted] , would agree to reissue the refund check with all heirs, and the proper mortgagee listed, however, that check potentially would be a challenge to negotiate as well This was discussed with [redacted] initially, however she stated that she had been paying the insurance and the mortgage so she felt she was due the refund [redacted] is happy to issue a refund check for the premium, however, we are charged with protecting the entirety of the estate of the insured and anyone who has a financial interest in the property and corresponding insurance
