Per Florida Statutes Chapters 718, 720 and 721 owners are required to pay fees due to natural disasters even if the unit cannot be used. This is unfortunate but all owners are aware when they buy the timeshare that there is always a possibility that something could cause the unit to be unuseable. They have a deed that is recorded at Bay County Clerk of Court and is considered real estate property so therefore are responsible for the property. All owners have lost the week and fees. We are a Not For Profit and run solely off of maintenance fees. Insurance only pays for damages but we still have to operate and pay all bills associated with the timeshare. Unfortunately also they cannot exchange because there is nothing to exchange, when you exchange another owner comes in your week from another timeshare and you use theirs. Since we are closed until at least October 2019 no exchanger can come in. We have explained this through letters and condo docs many times. If I refunded one owner I would have to refund all 4999 owners. Florida Statutes will not allow this. I sympathize with Ms. but this was an act of God and there is nothing I can do.
