Complaint: [redacted] I am rejecting this response because:At the time of purchase, [redacted] the salesperson told me there was a manufactures warranty from Subaru that covered the vehicle through 36,miles; the vehicle had approximately 13,miles on itWhen I called him back that Saturday, days later, he said just take it to Subaru & they'll fix it; I didThe dealership checked the records and said it was 36,miles or years, & the years, on the Subaru expired months earlierI called [redacted] back and was basically told toughEven without the implied warranty, any reputable business should stand behind a $22,purchase for at least a couple of daysI just completed renewal of my MtgBrokers License which covers all consumer loans, including you finance man, & under the SAFE ACT, MAP Act, RegZ & O, an implied warranty violates several lawsAside from that, I'll restate my original statement, because of the agitated state of your finance manager over my choice of financing, & not having proper title at our first meeting, he NEVER MENTIONED THE PURCHASE OF A WARRANTYBy the time I stopped by, went to pick up the check from PenFed, he was ready to get rid of me; just pointed and had me initial here ,here, here & sign here, and pushed me out the door; why? Thank you for making us aware our customers concern with the Subaru that was purchased from us. We have spoken with him prior to his contacting the Revdex.com and we have specifically addressed with him that he was offered a warranty. I know he denies this but, we have a document that the
customer has signed that states ‘Novak Motors offers a vehicle service contract on most units that we sell, and it is up to the consumer whether or not to purchase this coverage.’ In addition to this document, it is standard practice for us to verbally offer a service contract to 100% of our customers that purchases a qualifying car. It is our position that the customer declined this coverage and purchased the car ‘as-is’ and if there was any warranty remaining on the Subaru that it would be administered through the manufacture

Novak Motors takes our customers concerns and safety as a priority. We truly understand that without customers we have no business. I would like to share some additional information regarding the Town & Country Mr. & Mrs. [redacted] originally came in and purchased. They first purchased a...

2014 Town & Country. A few days after the purchase, they brought the van back to dealership and there was an issue with the rear brakes. I immediately assured them that we would correct the issue and provided them with a loaner car. I provided them with a 2015 Town & Country that was very similar to the van they had just purchased. The next day I had a mechanic look over the 2014 and he recommended a complete rear brake job on the van, so we did it. After the mechanic completed the rear brake job he informed me that the issue with the rear brakes was caused by driving the van with the parking brake applied. With all of this, Novak Motors did not charge or ask the customer to pay for the repairs. We then contacted the customer two days after they first brought the van and told them that we completed the rear brake job and the car was ready for pick up. I also shared with them the mechanics opinion of why the issue occurred. Once Mr. & Mrs. [redacted] arrived at the dealership they asked if they could keep the 2015 Town & Country and return the 2014. After a bit of research to find out what all needed to happen to accomplish this, I told the customer that we could do it. We then completed the paperwork and everything seemed to be fine.  Mr. & Mrs. [redacted] originally took the 2015 on a Tuesday evening and had no issues whatsoever. We then received a call from them on Saturday and they stated that the 2015 was having the same issue as the 2014. After Novak Motors spoke with a few different mechanics about the situation, they all agreed that the wear found was caused by the parking brake being applied. With all of this information and the fact that the same issue was happening with two different Town & Country’s the conclusion is the issue was operator error.  As far as the screwdriver stuck in the springs, I personally looked at the tools that my mechanics used and they do not use that specific type or brand of tools. So with that the only explanation that we could come up with is that it was some type of road debris that was picked up by the van.    [redacted]

Complaint: [redacted]
I am rejecting this response because:At the time of purchase, [redacted] the salesperson told me there was a manufactures warranty from Subaru that covered the  vehicle through 36,000 miles; the vehicle had approximately 13,400 miles on it. When I called him back that Saturday, 2 days later, he said just take it to Subaru & they'll fix it; I did. The dealership checked the records and said it was 36,000 miles or 2 years, & the 2 years, on the 2015 Subaru expired 3 months earlier. I called [redacted] back and was basically told tough. Even without the implied warranty, any reputable business should stand behind a $22,200 purchase for at least a couple of days. I just completed renewal of my Mtg. Brokers License which covers all consumer loans, including you finance man, & under the SAFE ACT, MAP Act, Reg. Z & O, an implied warranty violates several laws. Aside from that, I'll restate my original statement, because of the agitated state of your finance manager over my choice of financing, & not having proper title at our first meeting, he NEVER MENTIONED THE PURCHASE OF A WARRANTY. By the time I stopped by, went to pick up the check from PenFed, he was ready to get rid of me; just pointed and had me initial here ,here, here & sign here, and pushed me out the door; why? Obviously, he wasn't getting the finance commission on the financing because I wouldn't take his higher finance rate, which also violates several sections of the Fair Credit Act.
