Purchased property that was falsely advertised as fee simple. Now delinquent in ground rent. Issue was supposed to be resolved but never was.
Hello,
I purchased *** Rd. *** MD XXXXX in October of 2010. My real estate agent was Stephanie *** My house was originally listed as fee simple however the seller of the property falsely advertised this and my real estate agent did not properly do her research on the property nor was she educated on the process.
Recently I've applied for a line of credit home equity loan for home improvements. Today, I found out that the property is still currently listed as having ground rent and was never switched to fee simple as I was told by my agent Mrs. McClellan. I've never paid ground rent once and I've never received a bill for anything like that. I currently am delinquent $288 in ground rent and never even knew about it.
The title company that currently owns my ground rent is Fillcrest Limited Partnership. The POC is William *** and his number is XXX-XXX-XXXX.
Feel free to call me at XXX-XXX-XXXX .
Thanks,
David
$288 for unknown ground rent purchase plus file the corrected paper work with the county to own the land. I was informed that this happened in 2010 and just found out that was never done and I was lied to by my real estate agent.

to me, Stephanie
Good Morning ***,
Thank you for taking my call this morning. In response to the letter we received, we have rectified the issue with the Client on 1/7/19.
The complaint we received was that the Client was trying to refinance his home and was having trouble doing so because there was a lien on his property for Ground Rent. I was able to access the public records showing that the Ground Rent was redeemed from the Title Company and posted to public record. I was able to provide this to the client for him to give to his lender to have taken care of. He thanked me very much and I let him know should he need anything else, I would always be happy to help. I explained that what could have happened was the responsibility of the Ground Rent owner to have received the paid deed from the Title Company. As a Real Estate Agent, we rely on the Title Company to handle. I was aware during the transaction that my Client was not interested in purchasing a property with Ground Rent. The Listing Agent incorrectly listed the property having no ground rent, and prior to settlement and the transfer of property, the Owner fulfilled the remaining Ground Rent to give my Client a home in Fee Simple.
Attached is the Ground Rent Redemption Deed that I sent to my client on 1/7/19, as well as our Text Message transcript.
Should you need anything else, please let me know
Many Thanks,
Stephanie
