Review: Northeast Motorsports representative [redacted] posted an [redacted] auction for a 110cc ATV. I purchased the ATV on [redacted] and was required to pay an "immediate payment" of $300 as a deposit to buy the vehicle...which I sent him through [redacted]. **. [redacted] called to inform me the vehicle I purchased was no longer in stock...but I could pay an extra $150 and get one from a different warehouse. I refused the offer and requested my money back. **. [redacted] refused to give me a refund for my deposit and has not shipped me the vehicle I purchased on [redacted].Desired Settlement: Refund my deposit in full immediately

I am rejecting this response because: While it is true **. [redacted] and Northeast Motorsports LLC eventually returned a PARTIAL refund of my deposit through [redacted], Northeast Motorsports LLC still owes me $30 in deposit funds he has illegally withheld. My [redacted] transaction with Northeast Motorsports LLC was not completed because the vehicle was not in stock and could not be sold at the price listed in the [redacted] auction. But this issue was not revealed to me until after I was required to pay a $300 deposit to secure the vehicle (which in fact did not exist). In essence, **. [redacted] is attempting to make his customer pay a penalty ($30) for his company not having the ATV in stock and available for sale as claimed in his [redacted] auction. It is illegal, unethical and against [redacted] rules to withhold deposit funds in this way since **. [redacted] did not have the vehicle in stock and was unable to complete the transaction according to the terms of his [redacted] action. [redacted] strongly recommended I not cancel the auction after the fact until my deposit was returned in full. Now I see why. **. [redacted] and Northeast Motorsports LLC became belligerent and refused when I asked to return my deposit as required by [redacted] auction rules. Now this seller faces sanctions by [redacted] and other agencies for failure to legally return my entire deposit and failure to abide by the terms set forth in the [redacted] auction transaction.I require the immediate return of all of my deposit funds.
