***They sold me a bad car, it is STILL not drivable but they want me to pay them for towing a car that broke down TWO weeks after I got it and I offered to pay to get it fixed somewhere else but they won't give me my keysMy lawyer will be contacting them soon because that car is useless and I have the title that is my carI have no problem signing the title over to them AFTER they give me my money back since they don't want to just give me the car and let me take it elsewhere, since they advised me they don't have the knowledge to fix it

I have reviewed the response made by the business in reference to complaint ID ***, and find that this resolution is satisfactory to me

The customer purchased a year old BMW with No Warranty sold as isWe worked on the car for him with no money out of pocket at the time of service and let him amend his account to a later due date.We only pull car fax by customer request so we were not aware it had been in an accidentIt has a
clear titleThe vehicle does not have an Immobilizer on itThe customer stated several times he did not know if he could afford the vehicle and was late on our amended date for Deferred payment and his regular paymentWe tried to work with him, he never asked about getting into another vehicle, he just called and asked us to come getThen went to social media instead of asking us about other options. We are not comfortable putting this customer in another vehicle or going forward with a new loan

We have made several attempts to contact Mr*** by phone and email regarding his accountMr*** purchased this vehicle the 3rd of AprilWe had to repossess the vehicle in June and we continued to finance the vehicle for himIn September we tried contacting the customer several times for
payment and Insurance after putting the car back out for repossession we received a call from the customer about the clutchWe had the vehicle towed to a near by mechanic and he did verify the clutch was outWe were working to see if the clutch had a warranty, unfortunately it does notMr*** was given a quote for repairs. He said he would call us back and never didMr*** is currently payments behindWe made contact with the shop to have the car towed to our location so no storage fees were chargedI am sorry for the situation and am willing to work with Mr***He called us yesterday asking for copies of our receipts and we have them here ready for him, Again we left a message and have not heard backWe are willing to replace the clutch and make payment arrangements for parts and labor, but the past due payment's have to be paid and full coverage Insurance renewed

The vehicle sold to this customer does have a clear title, if needed I can attach a copy. (A clear title does not mean it has never been in an accident) We have taken the vehicle on test runs several times since the customer turned the car back in to us and we have not had any mechanical issues with itIf the customer wants to resume the loan we can do soIf he is not comfortable with going forward we can release him from the contract and write off the amount owed

I am rejecting this response because:I knew the business we all about the money because every time I talked to *** he was only concerned with getting money from me and they knew the car was not able to be fixed when they got it back there is no repairing it and it's going to cost more to get it fixed than it's worth, bottom line you sold me a lemon and knew it and tried to scare me out of having it took to ford and only told me it was at ford because it can't be fixedI paid for a car that worked for two weeks

Bottom line is this vehicle is a 2002 PT Cruiser with No factory warranty and was sold AS IS. We will honor having the clutch replaced. ( the receipt shows "clutch kit"). Again, payments and Insurance will have to be caught up and we can work out arrangements for other transmission repairs if needed. Mr. [redacted] needs to contact us so we can discuss this with him. The last time we spoke to him he was given quotes on repairs and said he would talk with his wife and call us back.

Complaint: [redacted] I am rejecting this response because:the receipt L&N attached is for a flywheel not a clutch. And there is no receipt for labor they did and date they actually replaced the clutch. The repo in June was an insurance mistake which was no fault of mine and the repo has nothing to do with the repair of the clutch going out. Around August 2015 I was leaving Walmart in Belton Texas and I turned to get on the main road then when trying to shift I was unable to (the gear selector felt like a wet noodle). I called L&N about what happened. They told me right away check the clutch cable bushings they probably went bad. I did check them and they where bad, so I had to replace that myself because L&N was going to charge me 50 dollars to get it towed to their shop. The next day I replaced the bushings. When we looked at the bushings they looked old and tore up like they have never been replaced. Attached is photos of them.  And then Sept 7 2015 the clutch went out while I was driving back from picking my kids up from school. I was on the highway this time. I called L&N about it and they told me they did not have a mechanic anymore so I would have to go find a shop to look at the car. I got the car towed to Ray's certified Mechanics in Killeen Texas. the mechanic there looked at my car and said the clutch went out. He also mentioned to me that it never looked like the clutch was never replaced before. The mechanic at Ray's also noticed that two engine mounts on the car where no good and that was a safety issue. I went to L&N and told them what that shop said. They chuckled and said that shop does not know what they are talking about and it is more in likely just the cable not the clutch. I went back to Ray's and asked them if they where sure on what was wrong with the car. they said yes and printed me out what was wrong and how much it will cost to fix the issue. (Attached is a copy of the print outs). I went back to L&N and told them the pricing I was quoted. They said they would see about the clutch being under warranty. L&N told me a couple days later that the clutch was not under warranty and I would have to pay for it. They mentioned that they would work something out. L&N told me they could tow my car from Ray's shop to their old mechanic's shop in Belton. I had them tow it their. during this whole time I had to rent a car to get back and forth to work and to get my kids to school.(I even asked L&N if they where able to supply a loaner for me so I can not pay all this money on a rental, and they said no). I knew where the shop my car went to. I had to drive by that shop 4 times a day, and I noticed every day it was in the same location (outside towards the back of the shop next to another vehicle). After a few days of this I went back to L&N and asked them what their mechanic said. L&N said they would get ahold of him and find out what he said. Approx. a week went by and did not hear back from L&N. So again I went to their location. L&N told me that their mechanic said it was the clutch and possibly the transmission as well. So I asked L&N on how much that would cost to get fixed. They told me that it would be around 200 for the clutch , and a used transmission could cost anywhere from a couple hundred to 400 dollars and that I would have to replace the transmission not them. This was around the 14th of Sept 2015. I had to take a day off of work to get all this straightened out. I ended up getting fired because of my car being broke down (the following day). I was still in a rental car. I tried to get ahold of L&N a couple of times to let them know everything but one time their phone system was down due to Time Warner working on things, and the other couple of times I talked to a female their that I gave the messages to.  Basically between sept 15th 2015 to now I have not heard back from L&N about anything and I was unable to keep paying on the rental (cost 2,000 dollars) so I had no way to get to L&N personally. Regards, [redacted]

The customers initial desired settlement was a refund or her vehicle back. We delivered the vehicle to the Ford dealership for her and have waived her balance that was still due from her purchase. The car was sold without a warranty, we have gone above and beyond the settlement request from this customer.

I am rejecting this response because:The statements made by the dealer are false. The vehicle did not have a clear title. I advised the dealer the first time it was in a wreck after verifying it through Eurotech Automotive located in Killeen Texas. They did NOT offer any options after the 2nd break down and actually I did not go on google reviews until after not hearing back from the dealer. Their attempts to fix the issue with the vehicle has had failure obviously because it broke down again after the dealer claimed it was fixed. As a consumer I should not be stuck with a vehicle with mechanical issues right after purchase especially if the dealership doesn't offer no solutions. This was pure consumer theft and hustle because they will fix or patch the issue and sell it to some one else. Yet I'm out of my extremely hard earned money they took from me in guarantee of a proper working vehicle. I would like to say this is the worst experience of my life as a consumer and I will make it my life's mission no other consumer has to deal with this injustice from such a dealer whom sees no fault in there hand

The customer called about her car not starting and we sent a wrecker service, before he arrived it started. She brought the car soon after for us to look at. We replaced the battery and fixed a few minor issues. We received a call yesterday our receptionist gave the note to our salesman after...

lunch, unfortunately we are a small operation and he was unable to return her call before she called back. We did not charge for the other repairs we told her we would cover the labor on an alternator but she would be responsible for the part. The vehicle is sold as is. The customer stated that she herself had worked on the the vehicle, not being a certified mechanic we can not trust that some of these issues have been caused by her repairs. Being that she has had the vehicle such a short amount of time we are willing to cover the amount for the part. I feel we have gone above and beyond to accommodate Mrs. [redacted]. We do not exchange vehicles and this is not an option. The customer drove and inspected this vehicle before purchasing, signed an AS IS waiver.

We are sorry the customer feels she has been treated anything other than fair. We have gone above and beyond our obligation of regulations to help make this vehicle up to expectation. To make sure we were not missing anything after our mechanic worked on the car and she reported it stopping, we had...

the car taken to another reputable shop to have them evaluate it and they drove it out of town several times with no problems.Gary H[redacted] treated Mrs. R[redacted] with respect and always responded to her email's, I am not aware there is a way to block email?Due to false accusations from the customer we do not want to go forward with a loan on any further vehicles. We will refund the customer her down payment minus TTL a total refund amount of $2,338.75 if the vehicle is returned by the end of business day tomorrow 3/29/2018 in the same condition it left.

We have spoken to the customer and explained we will wave parts and labor. She can pick the car up after she has paid the balance from the sale price still owed and $200 Tow fee from San Antonio.
