August 18, [redacted] Revdex.comEuclid Avenue4th FlCleveland, OH 44115-Re: Complaint ID: [redacted] Complainant: [redacted] Dear [redacted] : In regard to the complaint that your office recently received, [redacted] submitted a rental application for an apartment on July 29, and was promptly approved, however he notified the office on August 6, that he no longer intended to rem the apartment for which he was approvedThe rental application that [redacted] signed is quite clear regarding the disposition of the deposit in such a situation: "It is further understood and agreed between the parties that in the event that payor withdraws said application, or in the event said application is approved and accepted by TRMCO, and payor refuses to enter into a lease agreement for the period of time as called for in said application, then the sum so received herein and the balance of the deposit as indicated on page one of this application shall be retained by TRMCO, to serve as liquidated damages for damages it will suffer by reason of payor's failing to enter into tenancy of the above stated suite."
