I signed a contract with Nicky's Attic on Sept 8th to run an estate sale at the home. It was originally scheduled for the weekend of Oct 19, and then switched to the weekend of Nov 9th. The owners of the shop came to the home to view contents. Margo and Bryant ***. They were the second estate sale company I called and I went with them because Margo also had the store that she could also sell items leftover. I was told they would both be at the house all weekend, they would come the day before to set up, I would get a full accounting of sales, and then I would receive a check for 60% of the sales two to three weeks after the sale. They were raving about all the items they could sell. *** various collectible items. I mentioned *** a coin collection that I was still undecided if I was going to sell. Bryant pounced and said he knew a guy who would pay top dollar. I said that I was not sure, but to get in touch with me and he bring the guy over to give me a value. The signed contract said they would sell the contents of home. Nothing in particular. He did not bring him. In the end, My kids took the Presidential collection coins, I took the coins that were left to 3 coin dealers and a pawn shop. The most I was offered was $450.00. Most of the coins were worth face value and not worth anything. I sold the others for $450.00. Margo brought the tables the Wednesday before sale and I ended up setting up with my neighbor because she was too busy and tired. Bryant came to do the sale by himself. I was told to go away for the weekend, which I did. He told me over the phone sales numbers that I know were lower than he received, because of witnesses at the sale. Almost 3 months later, they are refusing to pay me because he did not get to sell them. He said the coins were the only valuable item and everything else was junk and he was keeping the proceeds because I sold the coins.

This sale scheduled and rescheduled due to probate issues. We price our sale according to what the homeowner states will be in the sale on our initial visit. We have photos of all of these items and we use them in our marketing when we advertise our sales. This is how we come up with our commission structure and we expect the merchandise to be there. We arrived at home the day before for "set up" and the homeowner informed me that she "sold the coins because she needed the money." She gave the lawnmower and the canopy to the neighbor and so on and so on. Our contract clearly states that our commission is based on what we are told will be in the sale and anything omitted after the contract is signed will be deducted. This is how we protect ourselves from people "wasting our time." We could have taken other, more lucrative, sales but we kept our word to *** and would never cancel. But, we are not in business to clean up your mess for free. There was nothing at the end of the sale worthy of bringing back to my store. It was all dump worthy. She did not want a cleanout price which we offer at the end of every sale per the contract.

We never told *** that she had to leave the home. Our contract states that the homeowner is welcome to stay on the premises and many homeowners do stay. She chose to leave for the weekend. Instead, her neighbor walked around the sale all weekend in her pajamas while smoking, talking to our customers (who were repulsed), interfered with our sale and witnessed the sale first hand. There was nothing underhanded going on here.

She, for whatever reason, thinks her *** dolls, old pots and pans and *** collectibles were worth a huge amount of money and they are not. We do not charge according what *** or the internet says things are worth. We sell to resellers and are essentially liquidating during a 3 or 4 day sale. Our contract states that we price the items and she could put reserves on items. never gave us a list of what she wanted reserves on. She just wanted to get out of there

I am rejecting this response because:

I do not agree with their assessment. They can in and started taking pictures of things. I told them I had not made any real decisions on everything I was selling. There were things I wanted, and my kids and close friends. I had not even agreed with them selling things and they were already taking pictures. The coins are what BRYANT *** has been complaining about saying they were worth a fortune, which they were not. My kids kept some that they wanted from various Collections. I told them that day I was not sure if coins were part of it. I said several times I was debating on certain things. I specifically told her certain things I was keeping and she took pictures anyway to post. He said he had a guy who could give me a price. I said I would want that done before sale so I could decide. Wife called and said Bryant was picking up coins on a later date. He did not come. I did research what I had left after giving my kids theirs, I then took rest to three different coin dealers, (professionals), plus even went to pawn shop just for heck of it. Pawn shop said nothing of real value. Coin dealers all said same thing, no disparity among them. Most of coins worth face value. There was some sets and some coins that had real silver. Those they all priced at about 400-450.00. I went back to one that offered me the $450.00. This was one week before sale and one week after BRYANT was supposed to pick up coins. There is nothing in contract stating specially what was to be sold. They were supposed to set up day before sale, wife showed up with two tables, that’s it. I said I could help and get things started because she had to go. I set up everything along with my neighbors. It took us 6 hours to do so. I had a friend there most of weekend and she wore sweat pants, not pajamas. She is heavy. I also knew many others that came by who reported what they saw. He was outside smoking all weekend, there were *** all around where he was. My neighbor does not smoke that brand. They reported seeing him take in large amounts of money on first day. Three different people witnessed over 600 in sales in 2 1/2 hours time on first day. One friend spent 300.00 by herself. He said he only made just over 400.00 that day in total. He was late arriving, did not show up on Friday at all. He was googling on *** to see what things were worth. Again witnessed, and he told me he saw my coins on *** selling for thousands of dollars. He was using *** to get worth. He admitted this to me. *** is hardly an accurate way to get prices. The same coin could be offered for $100 by one and 10,000 by another. Means nothing unless you know for sure what they were worth. I know for a fact I had some collectible *** $40.00 each and up. He sold for 10.00 apiece he claimed. My mother did not have junk. A lot of stuff was from craft shows, QVC and other places. Many items were over 50 years old. The table and the ripped canopy was not sold at end of weekend so I gave it to neighbor for watching over place during sale. They were not sold before. Canopy had large hole. He left sale with a beautiful bakers rack he wanted to sell at his store. He rejected offers on it for $150 at the sale, I never heard what he sold it for. My tenant bought dining room for 400, and then only paid $150.00 down and no more. He did not include bedroom set in sale price which was about same cost. Wash with both items. Power lift chair was brand new and they were supposed to sell for at least 300.00. He let go for 100.00. Other items friends said they paid for were higher than he reported. He reported approx sales, but I never got full accounting as I was told in contract. The sales I was told about came to about $2,100, not including bedroom and dinette. I was due 60%. I kept texting kept hearing soon. He then sent nasty texts about not giving me any money because of the coins. Nothing else, just the coins he was angry about. He said rest of stuff in house was junk and he sold it as junk because I sold the coins on him. They were HIS sale. I was quite clear from the start I was not sure of them and other items. This went back and forth and I put bad reviews up online. I had several people respond to me about their own negative experiences, similar to mine. Rude, nasty, crooks were all similar responses I received. *** got involved, and contacted BRYANT and BRYANT said I was not getting a penny until all bad reviews were removed. My son told him all the laws he was breaking, but *** suggested I just do that and get some of money owed and then follow through with complaint to you. I took down reviews, contacted you at Revdex.com. Bryant sent money order for $1,000. Not what I was owed. He wanted the Revdex.com complaint withdrawn too since he now had heard from you. I was tired of this man’s nastiness and blackmail. Always nasty and rude. I had to do what he said to get Any of money he owed me. *** against me and others that contacted me, so I did not withdraw complaint. These people take advantage of bereaved family members, as they took advantage of me.

They have no business being in state sale business.
