Unsafe vehicle to use on roads
On the 6/21/2019 went to McKibben Powersports Honda in Winter Haven, Fl. We bought a 2012 Can Am RT-S as is per sales contract and paid the $299.00 required for them to inspect the motorcycle. I also paid $11,062.73 for the price of the motorcycle that FRSA Credit Union financed. David *** and Jeff *** both said the motorcycle was in good working order and there was nothing wrong with it. After signing the paperwork we had problems getting the motorcycle into reverse and out of reverse.After Melenie *** came out a few times and even had to pull up the shifter to release it from reverse and told me to read the manual. On 6/24/2019 it overheated and had to be returned to the dealership. I was told it was just an overflow on the radiator, but it was a cracked reservoir for the coolant.They took it to *** in Kissimmee,Florida for a diagnostic.I also told them I smelled fuel and the clutch and the reverse did not work right. David *** and Jeff *** said there was nothing wrong with it. Wouldn't even look at it. They told me to fill it up with gas and the smell would go away. I didn't get it out of the shop till 7/82019. The only thing they fixed on it was the coolant reservoir.The same day I went to *** and they did a diagnostic on it and said it was a fuel purge valve and canister needed replaced. Also the clutch was tampered with screws,bolts and parts of the clutch were missing. CFP also said it was unsafe on the road because of the mechanical issues. And it is still at ***.
To repair it without any cost out of my pocket because they did not disclose that the motorcycle had a major mechanical issues. And because it was unsafe for the road in it's present state.
Refusal to refund a refundable deposit.
Made a deposit on a vehicle with *** on 5.18.19 at 5pm. She explained multiple times that the $500 deposit was 100% refundable before taking my credit card number over the phone and that they could only hold the vehicle for a week. After receiving news from my bank that the allotted time would be exceeded, I requested financing through Honda via McKibben Powersports. She committed to providing all of the details by the next day via phone and email. After leaving multiple messages and not receiving a response, I decided to purchase a vehicle elsewhere on 5.23.19. She finally responded on 5.24.19 via text message. When I explained that it was too late, she informed me that the deposit was no longer refundable. I spoke with *** who I was told is the store manager (but not according to the website) that same day. He explained that his plan was to terminate ***'s employment but refuses to refund the deposit.
Refund of $500 deposit
All deposits are non-refundable on units since there is a limited supply of units compared to customer demands. If all deposits were refundable, then why would a company even request a deposit on the unit. The only time we refund a deposit on a unit is only after we can't obtain financing for the customer on the unit they have requested. In this case, Mr. received an approval from Honda Finance and a fair rate based on his current FICO score. We disagree with a few of Mr. accusations since our traffic log system indicates that our sales staff member *** contacted Mr. multiple times during the sales process, including text messages and messages left by voicemail. The system indicates that we did not receive a response from Mr. for many days after he shopped around to other dealers and then bought somewhere else. Our notes also indicate that Mr. was informed of our deposit procedures and was willing to put his deposit down, knowing that if he was approved, the deposit would contribute to his down payment on the unit. Based on Mr. financial approval and our guidelines, we couldn't refund Mr. deposit after holding the unit for one week, obtaining an approval, and preparing documentation. We sincerely apologize for any misunderstandings and wish Mr. all the best with his new unit!
