I had two issues in my complaintSinking pavers outside my patio door and

both of my original complaint issues taken care of plus an additional year
warranty on the repair that they will be fixing (sinking pavers) just in
case it happens again(this was the second time)
I need all
the silicone smears cleaned up on the *** wood panels. The silicone
was to cover up a tiny nail holes. The smears as shown in the pictures
are anywhere from a quarter size to two inches long. (why?)

wants his $1,for the water feature I ended up finishing, $3,for a roof,
that is not level, corners up-turned, roof crown vent that should of been
constructed out of wolmanized wood instead of plain wood so it would not
turn black as it is now. Every email he responds to has this.
Again, Read the complaint with the issues. The reason is in there
for the holding of funds.
In my
opinion only, the right thing is for *** *** and Land Creations to re-fix the
issues that were issues even before the job was completed.
(sinking pavers) Again, we had to call them back during the building
process because it was holding water and the water could get into the
home. I think we will always have issues with this. Hope not
I would
love my bar top to be at 42" but that will not happen. In my
opinion, a lot of these issues happened when *** *** subcontracted other
companies and there was no supervision from Land Creations there during the
building process as it shows in my problem section of my email.
(wrong color roof tiles on outdoor kitchen, put cedar wood on
kitchen instead of the no maintenance *** wood panels as we
requested etc.) The first project we always saw *** ***, the second
project it was mostly when there was a issue
I could go
on with more problems that we had but that would be bashing
I would
like *** *** from Land Creations to repair these issues and if he cannot or
will not, I would like the RevDex.com to post all
original transcripts with no editing that were discussed from both parties

contract agreement.There is one issue that is preventing me form taking care of things for him. He said we were paid and we were paid just not in full. He told me what he was willing to pay me and told me that he was keeping $1,500.00 for the water feature he was not happy with and he was keeping $3,500.00 for the pergola that he was not happy with. We offered to make any changes that he wished. He told us he would “just keep the money and live with it”. I told him that per our contract if final payment was not made we do not give a warranty. That is when he started yelling and swearing and told me to get off his property. I talked to him and tried to settle him down. We agreed to disagree and that was where it ended.If the homeowner is willing to settle up on the outstanding balance of $5,007.25 that he owes us I will take care of his claims within 5 business days for receipt of final payment.I am willing to work with both you and the homeowner to resolve things as soon as possible. Thank You [redacted]President Land Creations Landscaping Inc.

Thank you for your response [redacted].  This may sound redundant but...Outside French Patio door pavers were originally done say June 2013,  I emailed you around July 2013, that they were sinking and holding water. Your team came out , removed the pavers, added more sand and leveled them again.  Thought they were fixed.I emailed you in late December 2014 beginning Jan 2015 about the sinking pavers problem again and now we have the Revdex.com involved.What will happen if you fix them again in the next month or so and say after this winter or next spring they start sinking again?It has happened two times all ready.  What guarantee can you offer me that the pavers will not sink again?This is why I am asking for another warranty on the pavers.  If you are going to fix it permanently so there will be no more problems, who cares what type of warranty you give me. Three years, five years?If you know the pavers will not sink after you fix them again, why not give me a 2 year warranty on the repair?I am not asking for a 5 year or 10 year warranty on the pavers.  If they hold up and do not sink in 2 years like the they did again, they probably are fine and will last 10 years.I would hate to do this all over again with the Revdex.com and contact them 15 months from now and say see, I told you so, the pavers are sinlking again and [redacted] and Land Creations do not build or do quality work.If you are stuck on the no warranty, I am letting the Revdex.com know right now in this email that I will contact them again if they sink within 2 years because you do not believe in your own workmanship that you can do this repair job and guarantee me any peace of mind that the pavers will not sink again.  (that would be three times)True Example:   A fuel sensor went out one month before my new car warranty expired on my car. After they replaced it free at no cost, they also gave me a 12 month, 12,000 mile warranty on the part and laboreven though my new car warranty would expire in 30 days.  They did not say you only have 30 days left on your original warranty, if goes bad again, too bad.  They warrantied the part and repair again.If you know you are going to do a professional, high quality, permanent repair on the pavers, back it up with another warranty.  Most reputable companies give warranties on their repairs.  I guess you dont.  Thank you[redacted]

Again
for the third time, if you would not have made all the mistakes on
the outdoor kitchen roof, wrong bar height, not finishing the water
feature, you made a bunch of mistakes, putting Cedar on instead of [redacted], plus other items, you would have received your $5,000.  Since you did not do the quality of work that I expected from your company and I repeat for the third time, a bar top that
is made for basketball players to sit at 46" , a roof that looks like a
Japanese House/Pagota with turned up corners, sinking pavers for the third time, large silicone smears over tiny nail holes on the [redacted] pillars, work that I had to finish (water feature) and you expect me to pay you in full?   Your company should be called Land Creations, we Do and Redo because we cannot follow instructions to do it right from the first time Inc.There must be really something wrong with you.  Who in their right mind would pay in full for something as screwed up as the work you did.  I should of deducted $10,000,  I was being fair.  You need to get off this pay in full thing.  You do shabby workmanship, you were never here except the time your foreman cut the [redacted] wrong which again we caught and pointed out to you and you had to come out here yourself and cut it.  So much for your foreman who is not with you any more.  Your foreman was hardly here, only when I called to complain, and the last time he was here was for the water feature that he never finished.  That is why you did not get paid in full.  How hard is that to understand.  Let's tell everyone more issues we had and if it was not for me catching them the patio would look terrible.  Water feature was not centered in front of [redacted]'s patio door.  Brickwork was done and I looked at it that evening and called you and said the water feature is not centered to [redacted]'s patio doors and that the wall was too high.  You thanked me and your people had to come back out, remove one coarse of bricks on top and two courses of bricks to the left to center the water feature.  You designed the steps to go up to the knee wall, I said [redacted], the design that you did does not look right.  I need it changed.   I had to pay almost $750.00 change order to shorten the steps so it would not go all the way out to meet wall.  And when it was done, [redacted], what did you say to me?   I will tell you, you said: "I did not think it would look good, but now that it is done, I really like it".  And you charged me $750.00 to make it look better than what you wanted and designed?  If you want to completely remove the outdoor kitchen roof and put a new one on, put shingle felt on like I wanted, remove my granite bar top and make my bar top 42" to the top instead of 46", replace the sandstone pillar brick so they do not have to be sliced out 2" so the bar top would fit under the brick which really looks bad, fix my sinking pavers for the third time, remove the big blobs of silicone on all my pillars, and you can deduct $250.00 of that money for me putting back and stabilizing the insides of the water feature and putting it back together.  You want your $5,000?  It will cost you $10,000 to get $5,000.  You just don't get it.  Probably no one ever stood up to you with your poor workmanship or they did not know any better.Whats wrong [redacted]?  You think the pavers will sink again for the forth time and that you are scared to give another warranty on them?  You are using the contract as a wimp out.  I know it is hard for this to penetrate your brain, but BECAUSE OF ALL THE MISTAKES YOU MADE HERE, YOU DID NOT GET PAID IN FULL.  IF YOU WOULD HAVE DONE THE JOB CORRECTLY AS THE CONTRACT STATED YOU WOULD DO, YOU WOULD HAVE RECEIVED YOUR MONEY.IT MAY BE HARD TO UNDERSTAND [redacted], BUT YOU, AND I REPEAT AGAIN, YOU DID NOT HONOR YOUR OWN CONTRACT TO ME.  YOU SAID I WOULD GET THIS BUT I DID NOT.  I think I am going to take all the copies of these emails and transcripts and publish them in the [redacted] and [redacted] and let the people decide who is right.What do you think [redacted]?  I have nothing to lose.  Just a Roof that looks terrible, a bar top that is way too tall to use, sinking pavers for the third time.  I will publish my address and have people come out to look for themselves.  I will have them write a review, sit at the bar, remove everything from the water feature just like you left it for me, have them look at the sinking pavers that sank for the third time and then I will pay to have their response published in the newspapers and let them make a unbiased decision if you did the job 100 PERCENT correct or if I am correct for holding back the money.  I will also get union Masons, Union Contractors and union Roofers to come out and give me their opinion.Let's go for it [redacted]!  I am tired of your wimpy excuse of the contract.  Your never fulfilled your own contract with me. I am sure I am not the first person to with hold money from your company for poor workmanship.  Give me a warranty reassuring me that the pavers will not sink again.[redacted]

Business responded to rejection:I have had a chance to review Mr. [redacted]’s claims. I started my business 24 years ago and I have always done my best to resolve any issues that come up with our clients. I believe that our rating with the Revdex.com attests to that.It’s easy to go back and forth saying bad things about each other but I don’t want to do that. We created an awesome outdoor living area for the [redacted]’s. Yes, we had some issues and we resolved everything that he asked throughout the building process. We offered to address any issues he had at the end of the project and he refused to let us do so.We had worked for the homeowner before we installed their front yard landscaping. That project went great and there were no issues. We enjoyed working with them on both project and I thought that relationship would continue. It’s unfortunate that things ended the way they did.   I am willing to resolve the issues with the brick that has settled on the landing. I will contact the homeowner today and let them know that we will address their issue with the pavers that have settled. I want to do the right thing to resolve this for them. ID # [redacted]'s response makes it sound like I was just unhappy with the water
feature and Pergola and just decided to withhold money for no reason.
I
would like to start from the beginning with the issues we had
throughout the outside patio process with Land Creations and [redacted] who [redacted] Sub-Contracted.
First
Big Problem: Land Creations Contracted [redacted]
Company to build the outdoor kitchen. They put the wrong colored
shingles on the outdoor kitchen roof. The
outdoor kitchen is 15' x 15'. The roofer started the shingles early
in the morning. My wife also left for her job. When my wife can home
in the afternoon she noticed as she was driving down the street that
something was wrong. The outdoor kitchen roof was a total
different color than the roof on our home. She went to the back yard
to tell the roofer there was a problem. The roofer said to my wife,
this is what you picked out and I put the roof up. My wife again
said it was not right. A small confrontation started and he grabs
the paperwork and shows my wife the work order. My wife said they
are the wrong color and you need to call someone. Well after all
this and the roofer making my wife feel like you are a woman and you
do not know what you are talking about, we got hold of [redacted]. Yes, [redacted] said the shingles were the wrong color. Whoever wrote the work order
transposed the last 2 numbers and the color was completely different.
The
problem I have with that is why didn't the roofer see himself that
the color did not match our roof. It did not matter, he was a worker
and his job was to put the shingles up. He did not care or he would
of noticed it and stopped the job and call his boss or [redacted] and
say something is wrong. The colors do not match.
Now
they had to rip all the shingles down off the roof, 800 staple and
nail holes in my roof.
The
correct shingles were finally installed. Not sure about this under
layment that they used. Was not roofing felt. Looked like house
wrap or Tyvek. It was never replaced. House wrap (Tyvek)
with a bunch of rips and holes in it used again. I did confront the
roofer on the ripped Tyvek and he said it would be fine.
A
few days went by and as I looked more at the roof, the shingles did
not have a double starter layer like all roof have. After calling
[redacted] on this error he contacted the roofer and they agreed and
once again, they had to rip off 3 rows of shingles to put a starter
layer on to protect the roof from water and ice damage. More holes
in my roof. (I have email)
The
roof is not squared and level. All the corners are upturned 2
inches. I had to help Land Creations employees put up trim strips
and push in the middle to try to get the board straight. They could
not do it themselves. They even said this roof was bad. The roof
was bowed too much in the center. The board is still bowed. We
complained to [redacted] but he said that is the way it is. Funny, my
house roof line does not look like that. Reminds me of a Japanese
House/Pergola with turned up corners.
The
wood on the vented section of roof on the outdoor patio is turning
black. This wood is unprotected from the elements. I am not sure
but if the roofer used plain 2” x 4” wood and not weather
resistant wolmanized wood, plain untreated wood turns black and
molds. All the wood on the top of the roof is BLACK.
Second
Big Problem: We told [redacted] we wanted the kitchen to be
maintenance free and we wanted the [redacted] PVC man-made wood product for
no maintenance. [redacted] understood this. Well, from [redacted] to the
contracted [redacted] company this information did not get to
them. They did the whole outdoor kitchen in Cedar wood. Cedar has
to be stained and cared for. HIGH maintenance for me. Bee's and
some insects love cedar. That is why we wanted the [redacted] man made
wood paneling so we would not have to do anything or have insect
problems.
Well
again we have to call [redacted] from Land Creations and again, [redacted] is
sorry for this mistake and guess what? This gets all ripped off the
outside patio and again now 2000 unnecessary holes in my outdoor
kitchen.
Third
Big Problem:
Water Feature leaked all the time. They tried to fix it at least
four times. I never could use it. They actually forgot about it and
and never came back to finish it. [redacted] thought it was done and when
he found out it was not done he sent the email that I enclosed with
the original documentation.It did not matter, I fixed the water the water feature
myself so it would not leak and put it back together, not Land
Creations.  (See

Forth
Big Problem:
The outdoor kitchen was supposed to be normal bar height of 42
inches. My bar top is 46 inches. Almost to my chest. If you sat
on the normal bar stools that I purchased, the bar top was at your
shoulders. I had to return those bar stools and had to order custom
bar stools made with a 36” high seat verses 32 inch stools. Yes,
[redacted] reduced the bill $600 for the stools I had to buy but you
literally have to climb up the stools and you are sitting on a stool
3 feet in the air. It is hard for some of my older friends including
myself and I am 62 years old to get up on the stools and the ladies
have a hard time also. You look ridiculous sitting on this high stools.  Looks Bad.
Fifth
Big Problem:
The problem we are having now with the top patio landing with the
paver's sinking again. They had to fix it one time before the job was even
completed. Plus, again I had to call [redacted]'s right hand man Matt, after the first time they sank and
ask if they were coming back out to put the silica sand in the cracks
because it was going to rain. He said I could do it because they
were on another job.I finished that job also.
Now
the total cost for my outdoor patio was approx. $78,000. [redacted] received
$14,000 down February, 2013, $34,000 on April 2013, $20,000 in
August, 2013. With all the issues we had with Land Creations and
especially with the bar top being wrong size and the water feature
not being done correctly, the patio step paver's sinking the first
time, I held back $1,500 of his money. The owner of [redacted]
company never even came out to see us with all the problems we had
with the wrong shingles, wrong wood work on the outdoor kitchen,
flared roof corners on the outdoor kitchen roof until I said I am
going to hold back some money from them. Now he shows up. [redacted] wanted $10,500. I held back $3,500 for all the issues of wrong
shingles, wrong wood on the deck, holes all over, did not use roofing
felt. [redacted] did receive a letter from us and I have a copy on why we
withheld the money. At the meeting we had in the yard, yes it did
turn bad at first, but in the end we all shook hands and [redacted] said to
me when I told him I am with holding $1,500 from his total, he said
and I quote “ I CAN LIVE WITH THAT”. To me that meant OK to
reduce that amount from the invoice. The [redacted] owner was not
happy with the $3,500 being withheld. He said he could not give a
full warranty (with all the holes in my roof why would he) and would reduced his warranty to two years to match
Land Creations. He even asked [redacted] what his warranty was to us.
[redacted] is using this not paid in full as a escape goat when he agreed to
the money reduction in my yard with [redacted].
After
the agreement we then dropped off another $8,000 check to [redacted] at
Land Creations September 2013 as final payment.
[redacted] makes it sound like everything he did was perfect
and I just wanted to hold back money from him.
AS
YOU READ ABOVE, IT IS NOT TRUE. Look at the the issues we had with
Land Creations and [redacted] company.
Funny,
we having issues again with patio paver's sinking. Just like they
were doing before the job was even finished. [redacted] speaks of his
contract. I should have called the Revdex.com in the beginning with all
the issues we had to deal with from the start. I
gave [redacted] every opportunity to correct his mistakes.
Now I have some warranty issues I need fixed and it is a different
story. I contracted Land Creations to do a professional job the
first time. It was do and do over many times. Now we have warranty
work and Land creations will not honor it. Shame on me for not
stopping this from the beginning with all the issues we had with
wrong shingle color, no starter shingle layer, wrong wood trim, cedar
instead of the more expensive [redacted] PVC as we wanted, Bar top the way
too high to sit at, leaking water feature that I finally fixed, and
sinking paver's again.  Yet, I kept giving him ten's of thousands of dollars when he wanted it even with all the problems listed above.
