I am rejecting this response because:I wish to no longer conduct business with this company. In response to the complaints about double payments the company was not willing to help in any way, I should not have to correct it with my bank, it should have never happened and it happened two months in a row. I feel disgusted that I have lowered myself into any contract with a company that is predatory in nature. I did sign the documents and that is my fault, if I had known I would not have placed myself in this position. That is why I wish to discontinue any dealings with this company completely. I want to pay my balance and get rid of stress of a "company" taking advantage of unsuspecting customers. I want my account to be sent to collections and closed immediately. I do not want to talk about about it further, it cannot be resolved other than granting my wish. I want to pay the loan back, by all means, but I refuse to be taken advantage of. As previously mentioned, before she became bound by the agreement, NetCredit disclosed the Terms and Conditions associated with the loan, including the Loan Duration (22 months), Annual Percentage Rate, Finance Charge, Amount Financed, Total of Payments and the Payment Schedule. All of this information was disclosed to Ms. Mukaz, in addition, she always has the option to view her loan agreement which details all of this information, at any time when she logs into her account. I am rejecting this response because:I am a resident of the Commonwealth of Virginia. Section 6.2-1501 of the Code of Virginia clearly states that any company making a loan in Virginia must have a licensed office within the borders of Virginia. NetCredit's license status in the state of Utah in no way authorizes this transaction. Virginia Code section 6.2-1541 states that any contract violating the above-referenced code will be considered void and the lender "shall not collect, receive, or retain any principal, interest, or charges whatsoever with respect to the loan, and any principal or interest paid on the loan shall be recoverable by the person by or for whom payment was made." To date, I have made payments to [redacted] exceeding the original loan amount. I wish to have this account closed immediately and removed from my credit report as soon as possible.Sincerely, [redacted] For your reference, please see the following excerpts from the Code of Virginia:§ 6.2-1501. NetCredit. Ms. [redacted] signed her loan agreement stating that she agreed to the terms and conditions associated with the installment loan.
Prior to becoming bound to the agreement, NetCredit provided Ms. [redacted] with pre-contract information in the form of Federal Truth In Lending Disclosures. In addition, the charging structure, terms and conditions, and payment schedule were clearly laid out in the copy of the agreement supplied to Ms. [redacted] at the time she entered the loan transaction.

Our review of Ms. [redacted]'s customer file found that she paid installments one (1) through eight (8) in accordance to the contracted payment schedule. Further, our records indicate that NetCredit has not received payments from Ms. [redacted] since February 14, 2014.
We found no record or trace of the payment of $3,000.00 allegedly made to us in our systems. Our findings were communicated to Ms. [redacted] on March 9, 2015 and she was advised to submit supporting documentation so that we could investigate the matter further. Unfortunately, Ms. [redacted] has not submitted any documentation in support of her claim.
As the matter stands now, we would be grateful if Ms. [redacted] could submit documentation regarding the $3,000.00 payment so we can investigate the matter further. She may submit documentation via email or fax to:

I pursued [redacted] to get statements from this account. THey froze it after lender kept taking auto debits out of the accoutn despite payoff

As previously mentioned, we found no record or trace of the payment of $3,000.00 allegedly made to us in our systems. Our findings were communicated to Ms. [redacted] on March 9, 2015 and she was advised to submit supporting documentation so that we could investigate the matter further.
On February 28, 2014, $255.48 was due for installment number nine (9). Unfortunately, Ms. [redacted] did not make this payment. NetCredit received notification from Ms. [redacted]'s financial institution that she placed a stop payment on the transaction. NetCredit has not attempted to debit Ms. [redacted]'s account since that time.
Please note Ms. [redacted] asserts that we made debits to her [redacted] of [redacted] account. However, NetCredit does not have Ms. [redacted]'s [redacted] of [redacted] bank account on file. According to our records, Ms. [redacted] provided her [redacted] bank account ending in [redacted] when she applied for her loan. As such, all financial transactions including the funding of the loan were applied to the [redacted] account.

completed with her personal information.   On August 23, 2016, Ms. [redacted] reported that she did not apply for the loan. NetCredit advised Ms. [redacted] that in order for NetCredit to investigate her claim, it would need a copy of a police report or fraud affidavit.   After a careful investigation, it was determined the deposit of $1,980.00 was credited to a bank account registered to her name ending in [redacted]1463 - with [redacted] - on March 11, 2016. Therefore, based on our findings, and information available to us, we are not able to confirm that fraud occurred.   NetCredit strives to provide the ultimate customer experience and are more than willing to address any outstanding concerns she may have. As a responsible business, NetCredit adheres to all applicable legal and regulatory standards that govern our industry.
On January 23, 2014, Mr. [redacted] was funded a $2,260.00 Installment loan with NetCredit. This loan amount was agreed to be repaid in 76 installments of between $100.66 and $97.77 for a period of 1073 days. This repayment profile was clearly set out in the Federal Truth in Lending Disclosures provided to Mr. [redacted] prior to entering the loan transaction. Mr. [redacted] signed his Installment agreement acknowledging that he understood and agreed to all terms and conditions relating to his Installment loan.
On June 25, 2015, we contacted Mr [redacted] (as requested) to provide an explanation for the balance owed, however Mr. [redacted] did not accept our explanation.
On June 29, 2015, we worked with Mr [redacted] to arrange a payment plan tailored to his needs and the matter was resolved to his satisfaction.

Based on our review, NetCredit has submitted accurate information concerning this loan’s account history to the Consumer Reporting Agencies, and therefore, cannot remove the entries from Ms. [redacted]’s credit report. the Terms and Conditions associated with the loan, including the Loan Duration (18 months), Annual Percentage Rate, Finance Charge, Amount Financed, Total of Payments, and consequences of non-payment. Ms. [redacted] then signed her loan agreement stating that she accepted the terms and conditions associated with the installment loan. On September 15, 2015, NetCredit received Ms. [redacted] Power of Attorney (POA) from her debt management/credit counseling agency advising that they will be communicating with us on her behalf regarding her account balance.  As such, NetCredit has not attempted to contact Ms. [redacted] since that time.On March 24, 2016, NetCredit spoke with Ms. [redacted] and her debt management/credit counseling representatives and offered a settlement of $791.88 on her delinquent account balance.  Ms. [redacted] and her debt management company agreed to the offer. In addition to the agreement, her debt management/credit counseling was to submit a written proposal for the verbal agreement. Unfortunately our records do not indicate that the debt management/credit counseling submitted the required documentation.  However, we are willing to accept Ms. [redacted] payments towards the settlement arrangement and close her account, however, to confirm the details of the settlement arrangement with Ms. [redacted] NetCredit has attempted to contact Ms. [redacted], unfortunately she has not contacted us back. We ask that she please contact [redacted] in our compliance department directly at [redacted] to confirm and finalize the details of the settlement arrangement. Terms and Conditions associated with the loan, including the Duration, Annual Percentage Rate, Finance Charge, Amount Financed, Total of Payments and Payment Schedule in the form of truth in lending disclosures. Ms. [redacted] then signed her loan agreement acknowledging that she understood and accepted the terms and conditions associated with the installment loan. Based on our review, due to an inadvertent error, Ms. [redacted] was advised that her additional payment of $349.00 via check was not applied to her account. Subsequently, after further research we advised Ms. [redacted] - via email - that the additional payment was indeed applied to her account balance. With regard to the $8,000.00 check payment that Ms. [redacted] alleges to have mailed to us on June 5, 2017, we have no record of this check. To investigate further, we ask that Ms. [redacted] provide us with the address where the check was mailed, name of the entity that originated the check, check number, and any other markings that would allow us to track and identify the check. It should be noted that we have special instructions that we give our customers that want to pay by paper check to ensure that payments are applied on a timely basis. In this instance, we found no record of Ms. [redacted] having given us advance notice about her intent to pay by paper check. We apologize for the mis-understanding this matter has caused Ms. Shoemaker. provide financial services to residents of Virginia. Pursuant to Virginia law
NetCredit provides consumers with an installment loan under our Utah license,
pursuant to the Utah Consumer Credit Code, U.C.A. 70C-1-101. NetCredit does not
provide payday loans to residents of Virginia.Further, she signed her loan agreement stating she
understood and agreed to the terms and conditions associated with the
installment loan.Contrary to Ms. [redacted] assertion, our records do not
indicate that we advised Ms. [redacted] that would remove, alter and/or edit any
reporting to the credit bureaus. Ms. [redacted]’ did not make payments according
to the agreed upon payment schedule, and NetCredit reported accurately based on
Ms. [redacted]’ payment activity.Our records reflect she paid the full account balance on
October 27, 2015 through collections. As such, we have reported that Ms.
Devries has paid the account off.NetCredit reports all payment activity to two major credit
bureaus. TransUnion  and Experian. This information

September and October 2016. On July 21, 2016, Ms. [redacted] was funded a $4,340.00 installment loan with NetCredit. Before she entered the agreement, NetCredit provided the applicable disclosures and Mr. [redacted] signed her agreement acknowledging she understood and accepted the terms and conditions associated with the loan. In addition, the agreement explains the consequences of nonpayment and how it may affect a credit rating.  In review of Ms. [redacted] account, on September 2, 2016 a payment of $238.40 was due. The payment was processed via ACH (her primary method of payment at the time), however Ms. [redacted] also processed a card payment through her online account. This caused two payments to process on September 2, 2016. When Ms. [redacted] contacted us about the two payments, she was advised to contact her bank to stop payment since both payments were in progress at the time. Ms. [redacted] was able to speak to her bank and have a payment refunded back to her bank account. Following the incident above, Ms. [redacted] requested to call-in her payments instead of having payments automatically drafted from her bank account. NetCredit honored her request. On October 23, 2016 Ms. [redacted] contacted NetCredit again regarding two payments being processed. After our investigation was complete, NetCredit confirmed one payment was charged. To investigate the matter further Ms. [redacted] was then asked to provide documentation reflecting the two transactions. After that, Ms. [redacted] advised NetCredit that her bank was able to resolve the issue. On November 22, 2016 NetCredit attempted to process a payment as Ms. [redacted] requested, however, the payment was not honored by her bank. Presently, Ms. [redacted]’ account is past due. Based on our review, nothing has come to our attention that causes us to believe that NetCredit intentionally double charged Ms. [redacted] in September or October. In addition, our review of the loan performance information reported to the Credit Bureaus found that NetCredit is reporting accurately based on Ms. [redacted]’ payment activity. NetCredit values Ms. [redacted] as a customer. As such, we would be more than happy to address any outstanding questions or concerns that she may have regarding her account and/or available payment plans. Initial request forwarded 2/18/2018 indicated the exact response stated in this response (30 days to discontinue mailings). To date it has been 60+ days & I continue to receive mailings (9) therefore the request wasn't adhered to. It is not my responsibility to perform "legwork" by calling a toll-free number to stop the mailings. I did not contact this business for assistance nor do I have interest in any/all services offered & demand a cease and desist of future mailings Immediately!

application completed with [redacted] (formerly [redacted]) personal information. Before the agreement was electronically signed, NetCredit disclosed to the applicate the Terms and Conditions associated with the loan, including the Loan Duration, Annual Percentage Rate, Finance Charge, Amount Financed, Total of Payments and the Payment Schedule. Our records reflect that Ms. [redacted] made 37 payments in accordance with the payment schedule laid out in the contract. Ms. [redacted] account became delinquent when she stopped paying. NetCredit has accurately reported Ms.  [redacted] payment activity to the credit reporting agencies. On May 16, 2017, Ms. [redacted] reported that she did not apply for the loan. As part of our investigation NetCredit requested that Ms. [redacted] provide documents reflecting her claim of fraud. On May 24, 2017, NetCredit received documentation regarding Ms. [redacted] claim, however, upon review of the account opened in 2014 and related communication, our fraud department determined this was not covered by the recent 2017 fraud activity reported by Ms. [redacted]. We are willing to review any additional information that Ms. [redacted] believes reflects that the loan was fraud. Subsequent to the above fraud claims, Ms. [redacted] requested, pursuant to the Fair Debt Collection Practices Act, that NetCredit validate the loan. As such, NetCredit is the original creditor and not required to validate under the FDCPA; however, NetCredit provided her with a copy of the loan and payment history. NetCredit is an online lender and strictly follows the requirement set forth in the Electronic Signa**re in Global and National Commerce Act (“E-SIGN”). As such, Ms. [redacted] claim for her signa**re has been satisfied. NetCredit remains willing to review any additional documents Ms. [redacted] may have regarding her claim. After a careful review, our records indicate on March 6, 2018, one of its marketing partners referred the application in question to NetCredit....

What this means is that Ms. [redacted] input her information into another website that then linked her up with NetCredit as a potential lender. As part of the credit application process, consent was granted to NetCredit performing a credit inquiry so that the application could be considered for an Installment loan.  Based on the information provided on the application, we could not approve the request for the line of credit. As a result, a Notice of Adverse Action was sent to Ms. [redacted] via email. Since Ms. [redacted] is asserting that she did not submit an application for credit, we ask that she please file a police report with her local authority and submit a copy to NetCredit to launch an investigation.
