May 7, Re: Case# [redacted] Dear [redacted] I have read the letter from Mr [redacted] and the following is my response Mr [redacted] suffered a water loss to his home and we were called to come and provide services on 9/11/ It was stated to us that Mr [redacted] was to represent Leon going forward Our services include removal of damaged structural materials such as drywall and carpet We then place dehumidifiers and fans to dry the remaining moisture from structural components We do not service, repair, or even inspect any mechanical system such as heating and air conditioning These are specialties of licensed trades We performed the services that we were requested and authorized to do The estimate is very specific of what we were to do for both mitigation and repair We did not have any agreement to nor were we paid to look at any other issues or components of the home The home may or may not suffer of issues or problems that were not in the scope of work we were authorized and paid to do We were not hired to renew the entire home but only to do specific work in specific areas We were asked to provide additional service of cleaning some damaged personal property and brought in two specialists, [redacted] for furnishings and CDRN for textiles Mr [redacted] was satisfied with our services and paid us a $1,deductible and authorized his insurance company to pay us $(not $30,000) which we received 11/07/ Mr [redacted] then requested that we submit an estimate to make some repairs the home The estimate was provided within the week and the final revision is dated 9/18/ The estimated is detailed by line item in each room Nowhere in the estimate were we to work on a furnace The project sat for months before Mr [redacted] wanted to move forward and a contract was made available for him 5/1/ The contract was not signed by Mr [redacted] until 6/10/(not April) The contract is for days (not 30) and is for $16, The payment terms were $8,due on signing We did not receive the payment until 7/02/(weeks later and not in April) We had various sub-contractors look at the project and refuse it due to either location, condition of the home, the customer or other reasons that a sub-contractor may have for not wishing to do work on a particular project We found one qualified contractor to do the job and he complained several times of delays due to problems with attaining access and the conditions of the work environment Our sub-contractor could not reach Mr [redacted] to work out schedulingThen, in October Mr [redacted] contacted me for the first time stating that he was frustrated and that he could not reach us Finally, Mr [redacted] wanted to complete the work himself and asked for and received $1,on 11/14/of the $8,he had paid us We closed the job file as we were no longer the contractor He never contacted me again nor asked for us to do any more work until he emailed me 4/10/(months later) that he would like for us to come back and finish My understanding is that we were and that we were terminated when Mr [redacted] took over work at the property and asked for a refund I told him that he had terminated our contract and that we did not have any desire to work with him To clarify accounting, his insurance company paid [redacted] ($12,149.49) and CRDN ($4,677.70) direct We did not control those transactions and Mr [redacted] would have had direct control of what they did and when they were paid We received only the three payments - $1,deductible and $6,for the mitigation services that was paid after Mr [redacted] was satisfied and approved payment by his insurance company His satisfaction with that work led him to request us to perform some of the repairs his father’s home needed We then provided a scope of repair work and received a payment of $8, This is a grand total of $15,received (not $45,000) for both the mitigation services and the repair contract combined We paid the repair sub-contractor $4,on 10/03/and $5,on 10/10/ We paid Mr [redacted] $1, on 11/14/when he took over the project This is a total expense of $11,or roughly $3,more than the $8,Mr [redacted] paid us for the repairs When Mr [redacted] contacted me in October of and expressed his frustrations and my sub-contractor wanted off the job at the same time, it seemed a blessing to give Mr [redacted] more than he paid for when he asked for the refund But now for him to come back months later for more is absurd He took a refund, terminated our contract and did not finish his own work on his own project Sincerely, [redacted] President National Restoration, Inc
Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this does not resolve my complaint For your reference, details of the offer I reviewed appear below The that was released to me, was intended to be a credit for the insulation, I removed, replaced, and the painting I did of the east wall, for the material and time I put into the project, as provided under my contract for allowances, and credits, because NRI's failure to perform in a timely mannerThey then proceeded to seal up the insulation with no vapor barrier, hung dry-wall with no vapor barrier between dry-wall and contrete, there are several violations of wisconsin codeAs-well as an addition to an escape e-gress which was never explained to me, other then by a second contracotor I've had review my basement and bid the job to complete, what they are refusing to completeI have never expressed being released to the contractI have only stressed that it be finishedThe only time I have ever expressed being released from the contract, is if NRI agreed to pay an entire refund as-well as the punitive damagesI have expressed to [redacted] multiple times, my concern for his lack in finishing, as-well as the fact that their failure to perform is causing punitive damages to my property, as-well as drawing out a time sensitive issueHe insisted I continue working with ***, that the credit would be released to me, even though I requested multiple times for a new project managerThe dry-wall hung portion of the contract, which is all that is complete is only worth HIs excuse is complete bologna as-well as shallowStating he gave me 11,000+ in work for only an 8,200+ paymentWhen have you ever heard of a contractor giving away something for free? Why did it cost 11,000+ to only finish hanging dry-wall which is in the contract for 5,I have always held NRI to their contract, and only insist that they finish completeThat they were in breach, and if they wanted to breach the contractI wanted a full refund in entirity, or I wanted my basement finished to code, so that it may pass inspectionI have put several months of my time, now yearsIn trying to work with NRI in good faithAllowed them to negotiate with my insurance company [redacted] is the one who always expressed his deepest concern, and insisted he was going to finish my project, get everyone the best deal possibleThen they completely disappearHe states ***, quit my jobI have been in dialogue with [redacted] that he was fired mid project, not quitI feel that NRI must honor their contract complete my basement to code, or pay completely for another contractor to finish their job up to Wi building standardsNever that they simply be released, run off with my money, and get away without finishing a job which they entered into contract to complete"Sure just take my 8,200+ and run off with my basement in shambles" That is ridiculousI have stated multiple times only my concern for completion, and I believe their letter to be completely erroneous saying they gave me a blessing of 11,000+ when it was only 5,to hang dry-wallI had to hire an electrition as-well to move electrical boxes, purchase windows that they damaged claiming that it was the age of my structure that contributed to the damage, It was the manner in which they banged around with sledge hammers, and pry-bars to remove the previously damaged structureI believe NRI is completely accountable and must either finish the project, or release all payments in refundI have done work out of good faith accepting the 1751, as credit for my allowances as provided in my contractI even brought up the credit multiple times, and when they sent the check it was in a blank enevelope no letter attached, and I took it as credit, Even thanked [redacted] and [redacted] both for finally getting me the credit checkNever once did they say they were abandoning my project until this complaint process beganPlease I ask the Revdex.com continue to help in this ***er, and get them to uphold their contract, or get them held liable for finishing my basement as they stated they would finish itThat this was supposed to be a quick process and has drawn out for almost years nowI am really at my wits-end, they won't even give me a line-item contract to show what each portion of the job cost i.ethe value of the insulation I replaced, the painting I did, I'm not even sure if is a fair credit for the work I put in, and the electricion I hired at 450$ to move the boxes, and prepare it for them to hang dry-wallThere's a massive 2-inch piece of framing they put between apartition they hung just sticking out the floorNo flooring, no finish work with molding, no paint, nothing but dry-wall and mudThe window they damaged is leaking onto the clean fresh dry-wall they hungThere's no vapor barriers between the dry-wall and insulation to prevent vapor accumulation from my new A.c./furnaceI just don't feel completely that work like this, and contractul breach must be illegal to the fullest extentNot just unethicalI did the work they requested, cleaned up trash, removed old cieling tiles, did the electrical boxes, and went further to do insulation, when they couldn't make it out in time after my new hvac unit was installed because they had emergency callsThat's what the was for, not for release of the contractI hope that this clears up his letter, and can move us forward in finding out a fair and just settlement in this ***erI thank who this may pertain too, and look forward to speaking further, I apologize, that it took me some time to reply, my internet at the house has been down, and just now got my service reinstated, is there a phone # or way by mail to get notifications [redacted] *** [redacted]
