I was told they needed to switch out my credit card terminal. The rep came and did that, I signed 2 pieces of blank paperwork for the old and new terminals. That happened Dec.2016 a few months ago I call cancelling my service I was then informed there would be a early cancellation fee. I started doing businesses with them in 2012 the contract was for 3 years. I was informed that I had signed a new contract when they switched terminals. We never talked about a contract nor was there any disclosure that this would occur. The paperwork was brought back to there office where it was filled out, without me having any knowledge or agreement.
This client was re-signed to a new application that was fully filled out and also given a brand new *** chip machine. The applicant signed the documents in 2 different spots on the application and also put his initials on all 4 pages. He knew what he was exactly signing at the time.
2-3 months ago he called us to say he had a FAMILY MEMBER now in the processing business and wanted to cancel his account with us.
We have now talked with him on 3 different occasions and each time he keeps giving us a different excuse as to why he feels he does not have to pay an Early Termination Fee that is standard to all processors in our industry. If his FAMILY MEMBER was knowledgeable and truthful with him they would have made him aware of the Early Termination Fee when he signed up with them.
He instructed us to cancel his account and when we told him what the fee was he got very rude and angry.
We stand by our contract and in 14 years of processing have never had a complaint on an Early Termination Fee ever.
