ON SATURDAY, JANUARY 25, 2020, I WAS AT APPLEBEES WHEN THE BALL JOINT BROKE ON THE RIGHT SIDE. I CALLED MULLIGAN'S TOWING AND AFTER TWO HOURS THE TOW TRUCK ARRIVES. THE TOWING GUY LOOKS UNDER MY CAR AND SAID, "IT LOOKS LIKE YOU HAVE A BROKEN BALL JOINT". SO HE THEN PRECEDES TO HOOK MY CAR UP TO BE PULLED UP ONTO THE FLAT BED. DURING THE PROCESS OF HIM PULLING MY CAR UP, THE RIGHT SIDE WHEEL WELL STARTS TO BEND AND THE RIGHT SIDE FINDER WAS DETACHING. INSTEAD OF HIM STOPPING, HE CONTINUED AND IT CAUSED DAMAGES. HE ADMITTED IT WAS HIS FAULT AND GAVE ME A NUMBER TO A AUTO BODY SHOP THAT WOULD REPAIR MY VEHICLE ON BEHALF OF MULLIGAN'S TOWING. THE NEXT DAY (SUNDAY JANUARY 26, 2020), I CALLED THE TOWING COMPANY BACK TO HAVE MY CAR TOWED TO THE REPAIR SHOP THAT WAS FIXING THE BALL JOINT ISSUE. THIS TIME IT WAS A DIFFERENT TOWING GUY AND WHEN I EXPLAINED TO HIM WHAT HAPPENED THE NIGHT BEFORE AND HOW THE DENTS AND FENDER DAMAGES, HE TOLD ME THAT THE GUY WAS SUPPOSE TO JACK THE CAR UP BEFORE PULLING IT UP ON THE TOW BED. THAT SAME DAY, I CALLED THE COMPANY AND ASKED TO SPEAK WITH THE OWNER/MANGER OF THE COMPANY SO I CAN EXPLAIN WHAT HAPPENED TO MY CAR. APPARENTLY JIM MULLIGAN IS THE OWNER AND WHILE SPEAKING WITH HIM, HE TOLD ME TO SEND PICTURES OF THE DAMAGES AND THAT HE WOULD GET BACK WITH ME. I DIDN'T HEAR FROM HIM SO ON 2/4/2020, I CALLED HIM TO ASK ABOUT THE STATUS OF MY CAR BEING REPAIRED. HE TOLD ME THAT HE HAD NO KNOWLEDGE OF MY CAR NEEDING REPAIRED, BUT IN THE SAME DIALOGUE, HE SAID "MY DRIVER SAID THE DAMAGES WAS CAUSED BY A BROKEN BALL JOINT". I BEGAN TELLING HIM WHAT THE SECOND TOW GUY SAID THAT THE FIRST TOW GUY WAS TO DO BEFORE PULLING MY CAR ONTO THE BED. JIM MULLIGAN THEN BEGINS TO YELL, CURSE AND TELLING ME TO GO THROUGH MY INSURANCE COMPANY TO HAVE REPAIRED DONE AND NOT TO CALL HIS OFFICE EVER AGAIN AND THAT HE WASN'T PAYING FOR ANYTHING. AS HE WAS HANGING UP THE PHONE ON ME, I DISTINCTIVELY HEAR HIM SAY, "THIS IS WHY I DON'T LIKE *** WITH ***".

Jim stated that the consumer's car had a broken ball joint that caused damage to fender.
He explained, when a ball joint breaks, the car's suspension will fall down onto the wheel bending the fender.
He stated this customer called after the tow. He went by the customers home to inspect the vehicle and confirmed the ball joint was broken- again causing the natural damage. Jim stated he spoke with her on the phone and explained the damaged that occurred to her car when her ball joint broke. She then understood what happened.
Jim stated, that the day of the service call, his employee gave her two options for the tow- The first option cost $100 which included first jacking the car up, and would allow the company to put a block around the wheel preventing it from moving. This would still likely allow the car to push down onto the fender though. The other option was $50 which just removed the car from the street and pulled onto the flat bed. Since the fender damage had already occurred-prior to our service-, she opted for the cheaper tow.
"As the owner of the company, I am the only person who is authorized to offer any repairs. I did not authorize any repairs at a local repair shop. At this time, our company has completed the service call as agreed upon and does not feel we owe this customer anything."
I am rejecting this response because:
JIM ISN'T BEING HONEST! THE DRIVER NEVER OFFERED ME THE OPTION TO JACK UP MY CAR (FOR AN ADDITIONAL PRICE) AFTER HE LOOKED UNDER MY CAR AND TOLD ME IT WAS A BROKEN BALL JOINT. THE OPTION WAS FIRST TOLD TO ME THE NEXT DAY WHEN THE OTHER DRIVER CAME TO TOW MY CAR TO THE REPAIR SHOP. THERE WAS NO PRIOR FENDER DAMAGE TO MY CAR. JIM NEVER CAME TO MY HOME AND INSPECTED MY CAR. THE 1ST TOW WAS AFTER 11 PM AND THE NEXT DAY THE TOW TRUCK CAME AND TOWED MY CAR TO THE REPAIR SHOP AROUND 10 AM. I'VE NEVER SEEN JIM IN PERSON, ONLY SPOKE WITH HIM OVER THE PHONE AND THAT'S WHEN HE WAS BEING MEAN, RUDE AND UNBEARABLE TO TALK TO. HE IS CORRECT WHEN HE SAID HE DID NOT AUTHORIZE ANY REPAIRS. THE DRIVER THAT DID THE DAMAGE TO MY VEHICLE SUGGESTED I CONTACT THE OWNER FOR REPAIRS AND GAVE ME A NAME AND NUMBER TO A REPAIR SHOP THAT WOULD REPAIR MY CAR ON BEHALF OF MULLIGAN'S TOWING.
MY SISTER WAS WITH ME DURING THE 1ST TOW AND SHE WILL VERIFY THAT THE DRIVER NEVER OFFERED AND OPTION FOR TOWING MY CAR.
ID:14135308 im responding to the 2nd notice recived on Tuesday march 17 ,2020 I did go see mrs. *** car .the reason I didn"t speak to her at the time is because I did not want a confertation with her, I've done this for over 20 yrs and when you tell the customer we are not responsible for the damage to the car there is a problem . *** wanted the job done now and that's what we did , my employee has been in this industry also for more than 10 yrs , when a ball joint breaks on a car while moving or turning into a drive like she was its going to damage the car on the side that it broke on , as to the more money offered she wasn't interested she was wanting car out of street now and was told wasn't reponable for damages due to the failure of the ball joint , like I said in my first response google damages done when the ball joint breaks while car is moving what damages acure . as for me being rude and umbearable on phone she was the one who got heated because I wasn't offering to repair her car. I treat everyone with the same respect I get I was short and to the point we wasn't going to fix her car . as to the last statement my driver told her we wasn't responable for any damaged , even at the bottom of our recipts say not resonible for damages due to faulty tire, bumper brackets ect. I also told he if she had insurance to contact them and if they felt I was at fault to contact me and I would of address it that way too . thank you , Jim Mulligan march 27., 2020
I am rejecting this response because:
Mr. Mulligan stated that he's been doing this for over 20 years and if so, a business man would have knocked on my door and spoke with me. He cannot judge his previous client experience against me. It's apparent Mr. Mulligan has experienced a lot of unhappy customers in his 20 years of business. And from the towing experience, I see why. Mr. Mulligan's employees were more honest with me than he was/is. The first tow driver never offered me the option of paying more for a different type of tow for my car. When he realized he had damaged my car, he offered the name and number to a collision shop to repair my car on behalf of Mulligan's towing. So then, he was admitting fault. There was no anger or rude word exchanged between the driver and I because I understand mistakes happen. The next day when I called for another tow to take my car to repair shop, it was a different driver. When he seen the damage to my vehicle, he stated that the previous driver should have raised the car before pulling it up on the tow truck. This is when I first learned that there was another way of towing my car. The second driver raised my car before pulling it up on the tow truck and the fee was same as what I paid the night before, $50. I never signed a receipt, nor was I given a copy at either of the two tows. When I mentioned a receipt to the 2nd driver, he told me that he would leave the receipt with the keys when he delivered my car to the repair shop. There was no receipt and I would like to have copies.
As he stated, yes I wanted the job done, but I wanted it done correctly. My car was not parked on the street, it was parked in a parking lot when the tow truck arrived. I'm not disputing the fact that a broken ball joint could cause damages to a car. I'm disputing the fact that I was never offered the option of paying more to have my car towed correctly. I'm disputing the fact the Mr. Mulligan is not being honest by saying he came to my house and looked at my car. A true business man would have let me known that he was there and we could have discussed the issue. But instead, he waited until I called him about the damages to my car. I called him in a very professional manner to get the issued resolved and he, at first, acted like he had no knowledge of what I was talking about. As I explained, again, about the situation to Mr. Mulligan, his memory quickly came and he started yelling, cursing and being very unprofessional. His behavior and choice of words led me to believe he know that his driver was at fault and that he didn't want to take the responsibility of repairing my car.
