I chose to do a voluntary surrender on the car I purchased from them. Every payment was on time. I chose a voluntary surrender to avoid a history of late payments. I endured a financial hardship and chose to be responsible and give up the things I could n longer afford. Philmark--in conjunction with the lender used to finance my car-- reported my car as repossessed to the credit bureaus and this is false. When I asked them to change the status to voluntary surrender, they refused. I asked why. They said that because I missed the first phone call from them in regards to picking up the car, they logged it as a repossession. They are penalizing me for a missed phone call; that is ridiculous. I called them back and arranged the pick up, but that doesn't matter to them. In addition, they will not post my 100% on-time payment history. Its as if their goal was to sabotage my credit. By reporting my car as repossessed AND leaving out my 100% on-time payment history, it makes me look like an irresponsible lender. When in fact, I did the most responsible thing ever. I deserve for the FACTS to be posted to my credit report. And the facts are that I initiated the voluntary surrender AND made every payment on time and in-full.
I no longer have the debit card or bank account that I used to make my payments, and therefore cannot produce a record. I am depending on Philmark motors or *** to keep record of the payments. As a business, they should have records of all payments received by every customer for auditing and tax purposes. If Philmark and/or *** are claiming that my car qualified for a repossession due to non-payment from me, then they will surely have to provide my payment records to prove that. If they cannot provide a record of my payments, then they also cannot uphold the claim that non-payment was the reason for the classification of my account under repossession. How else could they back up their claim?
I purchased the car in Maryland, but the salesperson and the finance department understood that I reside in Virginia and would be registering my car in Virginia.
I called 3 weeks after purchasing the car to check on my license plate and the salesperson Tyrell B informed me they should arrive soon. I called back a week later to speak with the manager, Phil, who informed me they were not on the way because they needed my inspection information, which no one informed me about during or after the sale.I provided the information via email one week later and Phil said he would have my license plates sent overnight. I followed up two days later and Phil was out of town and no one had any information on my tags being sent.
I finally drove to their office for an explanation and worked with the “new manager” of that location Ivana, who assured me she would work on getting my tags. She informed me one week later that my car had a title in Maryland and a title in Virginia and she didn’t understand why. I purchased the car through them and did all of my paperwork through them, so I could not understand how that could happen without their knowledge. She informed me that someone would call me in a week with answers. I had to call them the following Tuesday and she still did not have an answer.
When I spoke with her on Tuesday, she said the same thing as before - she was waiting on an answer from Leslie who just got back from vacation and was “supposed to handle all of the issues from when the previous owner was here”. I still haven’t heard back.

I am sorry for the late reply on complaint #*** as I was dealing with a death in my family . We finally were able to resolve the title issue with ***'s car and secured her plates and delivered them to her . We have called and emailed her regarding the $94.00 reimbursement and we will be mailing a check out to her today so that we can close this case . Financial manager guaranteed warranty on vehicle and transmission for 1 year. Couple months after I purchased vehicle the same finance Manager was fired by the company because of ethics reasons. In lieu the promise in writing was not covered even though he told me it was bought when I made $2500.00 deposit. I am also still osying a car note for a vehicle I haven't drove since end of July.
We've contacted the customer and provided the remedy sought.

I am rejecting this response because: *** resperensative inspected the vehicle and confirmed the engine failure was due to mechanical wear and tear. Also from various shops and also *** stated that the suspension and the engine mount would have to be damaged to declare if a speed bump or pothole could have did damage. There findings shows that it was normal wear and tear which is a mechanical issue not related to any type of accidents cause by driver.

Mr.,Per our phone conversation attached is a copy of the WE Owe and a copy of the Buyers Guide. Ms. purchased the vehicle on 6/16/2016. A We Owe was filled out and signed by Ms. Stating that we would do the following: 2 Free Oil Changes, Center Console Cover, and A/C (I am not sure what the A/C means, but there is a check mark next to it). We were finally able to find the Console Cover and that was replaced around August 24th, 2016. Around April 6th, 2017 Ms. brought her vehicle next door to Philmark Service Center. They did an Oil Change and replace the fluids for her. Attached you will also find the Buyers Guide. The Buyers guide states that the Warranty is 1 Month or 1000 miles Engine, Transmission and Drive Axles. Ms. signed the buyers guide on the second page. Please let me know if you have any questions. Be as it may the vehicle engine failed because of mechanical wear. As they clearly stated I brought my vehicle in to be serviced by them as scheduled. I had the vehicle less than a year so the oil changes and fluid changes match what is normally done to a vehicle. So even though I know it was serviced and now they just proved they serviced my vehicle. I still owe the bank 5,500 dollars on the vehicle that malfunctioned because of mechanical wear and tear that occurred before I purchased vehicle and was covered up. Within the first week the engine light was on I took it back and the serviced the alternator, some how they left that tidbit of information out.
