I have been renting a unit from this properties company for 1 year and 11 months. I have signed 2 contracts with 12 month agreements. Originally when I signed the agreement almost 2 years ago, the agent that rented me the unit explained that if I was to not fulfill the full lease term, they could reach out to the owner and typically not pay the break lease fee which is 1 and a half times rent. I currently was trying to move out at 10 months of the 12 a few weeks back and it was stated that I had to pay the full break lease fee and that the owner didn’t care and wanted the full break lease fee. After I called back to talk to properties west 360, I got a agent that stated that they were unaware that I not only have lived in my unit for the 10 out of 12 months, but that this agreement was in addition to my first year that I had already lived there and that it is not right to make me pay a break lease fee after living there for this long. In the past 2 years I have paid over $31,000 in rent. And have been told different stories on what they can do for me to help me with this break lease fee.
This tenant contacted us stating he needed to break his lease two months early. We let him know what his break lease fee amount would be. He asked us to contact the owner, to see if they’d be willing to waive the charge. I did contact the owner that we represent, and (s)he, chose to not waive the fee. After communicating this to the tenant, he decided to stay another month and move out on 1/31/19, one month before his lease end date. A break lease fee still applies.
Last year, the tenant gave us his notice to vacate, with a move out date of April 30, 2018. On March 21, 2018, we did receive a rental reference request from another company for this tenant. However, on April 20, 2018, the tenant rescinded his notice to vacate and signed a lease renewal with us, renewing his lease.
When we offer a lease renewal, the form includes an option for the tenant(s) to sign another one-year lease or stay month-to-month. The choice is left up to the tenant. This tenant did sign his renewal opting for another year lease, with a term of 3/1/18 – 2/28/19.
Contacting the owner when a tenant needs to break a lease, is only a courtesy for the tenant, to see if the owner wants to waive the break lease fee. The break lease fee is in the rental agreement and an owner does not have to waive the fee. At this time, the owner did not want to waive the fee.
We do empathize with the tenant for his personal situation and his need to move, however, he did sign a contract. He is welcome to stay through February 28, 2019 to honor his lease agreement.

I am rejecting this response because: they lied and stated that they would be able to do something about the break lease fee. It’s a sad reality that over the past year and 11 months I’ve paid over $31,000 and renewed my lease where I not only paid 2 months worth of month to month rent, but I also didn’t move from the property, so that means there was no carpet cleaning which would have happened during a normal move out and no wasted month re finishing up the unit. Don’t lie to tenants about things to get them to sign contracts at the start to fill units, poor business practice.
