MH&R violated 42 CFR & 483.20 Resident assessment. This is a federal regulation that requires nursing homes to apply to see if the resident will qualify for WV Medicaid. Its called a "Pre-admission screening". The regulation requires its' completion within 14 days of patient admittance. This informs the family so that they can financially plan for the care of their loved one. MH&R knew that my dad would rely on WV Medicaid for long term care. They knew (as they are very familiar with the criteria for approval for medicaid) that he would not qualify. After I had paid MH&R over $21,000 (all of my dad's cash assets), after he had lived at the facility for 97 days, then they told me that he would not qualify for WV Medicaid and he would have to leave. Leaving me with no money, no options for the care of my father with a dementia/ Alzheimer's diagnosis and no back up plan. I have support documentations including emails, texts and the PAS rejection letter dated 30 days after the time line required by federal regulation. They violated the federal regulation and they orchestrated a timeline to receive all of my dad's cash assets, they forced him out and they are still billing me for over $9,000 dollars. They completely mislead me when I was completely transparent with them. Had they been honest, the $21,000 would have paid for 8 months of care at *** Assisted Living instead of 3 months of care at MH&R.
