The property manager recommended that I repaint the kitchen and bathrooms and steam the carpet to attract the best possible tenant, and I agreed. Subsequently, he contracted a vendor to render the service. The vendor completed the work two weeks after the specified completion date. The missed timeline in and of itself was not a significant issue for me. However, the property manager was unaware that the work was not getting done. I texted the property manager a week after the specified completion date to advise that the vendor was yet to start.
The worst part of this story is that the vendor took personal items out of my home including my 40 inch flat screen, internet router, cable box, dvd’s, brand new microwave (boxed), brand new led light (boxed), and brand new tea kettle (boxed). At this time, I still had roughly a third of my personal items in the residence. The vendor took all the items out of my closets, cabinets, and drawers and put them in garbage bags in my basement along with actual garbage. I took pictures of this and included it in the email referenced below.
I sent text messages to the property manager right away regarding this, which was roughly 7:55pm He did not respond the following morning so I sent an email to him with the owner and account manager copied in. The property manager texted me requesting a meeting 15 minutes later. During this call, the property manager indicated that there was miscommunication between himself and the vendor which led to removal of the property. All of the property was not returned as the vendor indicated he put some of the items in garbage bags which he was not authorized to do. The property manager became way less responsive after this ordeal which culminated in him failing to respond to me for an entire week. I reached out to the owner to discuss my options and solutions. The owner did not reply. I received a cancellation notice from the property manager 24 hours later.
Hello, Mr *** –I am sorry for your experience during the clean up and painting
of your property.
As you report in your complaint you had about one-third of
your possessions still in the property. You had originally stated to the property manager you would be out of
the property by the time the painting started. The delay in the start was to allow your cleaners to get the items
removed first. They were not removed in
a timely manner and as you were anxious to get the work started, the painter
had to remove them. Seeing photos of the property during this time they show a very
large number of items in closets, cabinets, on the floor, in the basement, etc. As you were supposed to be moved out, the
items appeared to be abandoned and were removed as they were preventing the
work to be carried out.
As you also state, most of the items were returned to you with
two exceptions. If you refer back to your
email of June 8 you stated the DVDs and cable box were the only items not
returned and you didn’t care about the return of the DVDs. A cable box was also
returned but you indicated it was not yours. That is the only item you identified as still missing. Please explain how you arrived at $598 for
compensation of one cable box. While the items should not have been removed, again,
they were returned to you. Had you
cleaned out the property as originally promised, the painting would not have
been delayed and your items would not have been removed in error to start the
work as contracted.
During this time, you had indicated you had move out but
instead were still living in the property. The property was not clean and presentable for showings plus you were
present during showings. This situation was seriously hampering our ability to
show the property and obtain a qualified tenant. It was decided that because you
were not allowing us to do our work, that it was best to sever the
relationship.
