Alex M of Merrill Custom Home Improvements took on a contract to replace carpeted stairs with new hardwood treads, risers, balusters, rails, newel post, etc... The new hardwood was to match the newly installed hardwood floors. Mr. M was responsible for acquiring the materials used for the project. Mr. M ordered and installed white oak treads which when polyurethaned turned brown and did not match the red oak floors which when polyurethaned were honey colored. After the first coat of polyurethane, the homeowners pointed out to Mr. M that the treads were not even close to color matched. Mr. M requested to re-evaluate the color when he put on a second coat which only worsened the color difference. Mr. M said he would replace the treads but needed monies from his next job to acquire the right wood. Mr. M collected his equipment and said he'd be in touch after his next job was finished.
After several weeks of no communication from Mr. M, the homeowner reached out to Mr. M to inquire on the status and Mr. M confirmed that he was still working on the other job. Mr. M did not respond to any other inquires until the homeowner asked for a refund of the deposit so they could hire someone else to do the job. Mr. M's response was "... I'm sorry to hear that you are unhappy and want to part ways. As far as the deposit if you read the estimate that you have It states that we do not give refunds for deposits or any other payments. Thank you for reaching out."
The homeowner reached out to Mr. M for the next two months asking for suggestions on rectifying the situation. Mr. M was never heard from again and made no efforts to make things right.

Refund For safety reasons, being without railings, balusters and newel post for 5 months (September 2019 - January 2020), we had to move forward with the project and hired another contractor to install the railings, balusters, and newel post. We can not afford to start the project over to install the right species of wood without receiving a refund from Mr. M. I'm seeking a refund of the deposit we paid to Mr. M of $1,775

Mr. M made no attempts to resolve the issue. He originally stated that he would come back and replace the treads with the correct wood but never fulfilled his commitment and all communications from him stopped a week or two after he left the job site.
