Merchant Service - D. Hall Enterprise

D.Hall was my merchant service provider. On October 6, 2011, he tried to convince me to switch my merchant services (3 accounts) to a different provider (through his own terms and conditions with the new provider). I was skeptical of the cancellation fee and refused the change. He continued to convince me that there would not be any cancellation fee of any kind and that he would write a paper guarantee that that would not happen. I agreed to that condition. He then wrote a letter stating clearly that he would be responsible for any cancellation fee to any of my accounts if that happens. What happened was later one of my account was charged $495.00, exactly as what I had been afraid that would happen. That happened in Dec 2011 and until now, I have talked to him for many times about that and he slowly trying to avoid resolving the problem. At first he said he would take care of it, but recently, he refuse to do anything. He basically refuse to take his responsibility and honor our contract. Technically, it was a fraud and I would like to file a complaint against him, the owner of the company, on this matter. I am not aware of what I should do to get $495.00 back.
