At McSherry they do not list the order of the items being sold, at the last auction I saw people that were bidding moving items from the back and placing them up front so they would bump other items that I was waiting on, plus I missed the entire tool auction because I could not be at both places at once, the people that owned the stuff lost money as only a fraction of the people there could attend both auctions, unfair to the owners and the bidders.
We are truly sorry that Mr., feels that he missed out on the Tools. We have a two ring auction given the enormous amount of product that we have to sell. (this is how it is always run) If a person would like to leave a proxy bid on either side, they are more than welcome to do so. As for moving the items, and having to wait for your item, this is how it is at all auctions. Our workers bring up a variety of items, in no particular order. If a customer is in a big rush for an item, all they need to do is ask our Auctioneer to sell the item, and provide him with a decent opening bid. We were very accommodating to Mr.. One has to realize that if you come to one of our auctions it is a full day event. We try to move things as quickly and smoothly as possible, however there will always be something that someone wants, and it will be sold later in the day.. Mr ***, was also *** to our staff complaining right from the start, he even approached our staff to look after *** while he visited the gentleman's room.
In the end , he did get his clock that he came for *** making our experience with him unsatisfactory as well.
I have a complaint regarding McSherry Auctions of Stonewall. Mr. did an auction for me September 24th. He told me I would get money up front, after the auction, which he did, and the rest within 10 days. I've contacted him twice since then. Once on October 13th and was told I would have it that week. Nothing. I contacted him again and on Monday the 23rd of October and he said he had been busy with contractors and a gun auction. None of which pertains to myself. I waited for the mail today and still nothing. Today, it's been a month since said auction. I'm hoping you can investigate this matter.

I just want the balance of what is owing sent to me. The total of the auction was $27,680.50. I received $15,000.00 the day of the auction. So I want the balance, minus what he charged for his expenses being 15% commission on the total and 750.00 for his moving people. Thank you, Marilyn
In response to Ms. Complaint about the remainder of payment due to her. Final Payment was actually sent to her prior to receipt of this complaint. A auction day deposit was left for her on the day of her auction, (including a print out of all items that were sold, as well as list of all who attended ) with the remainder to be paid once all the advertising and contractors bills to come in. Yes it did take a little longer , but this was due to the fore mentioned. (waiting for final bills to come in). Ms. situation was a mess, complicated by bad weather and poor transportation in and out of her property , which did not allow for normal loading, which required our assistance over and above our normal services. I believe that given the circumstances Ms. received our services over and above normal auctions, as well as receipt of the final payment cheque as fast as we could provide.

I accept that he waited for invoices. I don't accept that I received only invoices for a port-a-potty, advertising and nothing else. I've asked for clarification of other charges not agreed upon. One of them being that he offered assistance to purchasers regarding loading of purchased items and he charged ME for the cost of loading them. Those charges belong to the purchaser of said equipment if they needed his help. . I also see charges of loading the day after the sale. There was no agreement to anything the following day. I never agreed to pay him for loading purchased vehicles. That is the purchasers responsibility. Not mine.*** He was hired to work for me and do his best to get as much as he could, not overcharge me, which I feel he absolutely did.
In Response to Ms *** reply that no breakdown was received, it was indeed sent with the list of invoices. It also indicated on the consignor settlement in the expense area as "See Attached". It clearly shows a break down of labour, tractor use and loading, complete with a total at the end. Loading of items was pre-agreed upon in clause 4 of the contract signed (which Is proof that this was discussed). In addition, due to the rainy weather, the morning of the auction, it was discussed again as to proceed with the sale, and yard conditions being as they were for loading. Ms ***, agreed to proceed with the sale even with the situation of the yard getting worse, due to a nearing possession date for the new owners. It was always agreed that loading would take place the day of the sale and the day after. Loading was always an issue as Ms *** had an very inaccessible lane way of approx. 1/3 of a mile that has no gravel, which is equal to no access, and given the amount of rain, a loader was needed to transport every item and every vehicle out to the main road. If this service would not have been provided, there would have been no Auction or sale of any of the items. (as buyers could not access their purchases) Once again, I believe that all services provided were handled the same way if not over and above all other auctions. We did provide all documentation of bills, invoices, breakdown of loading/labour, consignor settlement and list of buys/attendees, we are unsure of what else is required. We never received any indication from Ms *** that she needed any further explanation. If there is something that needs to be resent we will be happy to provide it.
