It appears that the original notice of this complaint was forwarded to the Claimant’s local Matco Distributor in San Diego.? Matco Distributors are franchisees who are authorized distributors of Matco Tools, and, as such, are not employees of NMTC, Incd/b/a Matco Tools (“Matco Tools”).? Typically, any notices to Matco Tools are forwarded from the Summit County, Ohio office of the Revdex.com ? It also appears that this debt arose from a transaction between the Claimant and the Distributor.? Matco Tools provides several financing plans to creditworthy customers of qualified Distributors for large purchases so that Distributors do not carry such a large receivable over an extended period of time; however, Matco Tools does not have record of any account with this Claimant.? So, this receivable solely belongs to the Distributor and whatever collection activity performed by the Distributor was independent from Matco Tools and was not acting as an agent of Matco Tools ? The Claimant’s statement in the complaint that he would “seek to pay matco directly and have nothing to do with him” is not possible, since Matco Tools has no interest in this debt, and Matco Tools will not collect payment on behalf a Distributor.? I have reached out to the Distributor and urged him to respond to this complaint, but the Claimant will need to settle this complaint directly with the Distributor
