THE SHINGLE MANUFACTURER IS CURRENTLY DEFENDING SEVERAL LAWSUITS THAT ARE DIRECTLY RELATED TO THIS ISSUE. IT IS CURRENTLY BEING CONSIDERED FOR A CLASS ACTION LAWSUIT. WITH THAT BEING SAID, I HAVE CUT AND PASTED AN UPDATE FROM A LAW FIRM UPDATE (LATE 2016). "The presiding judge in this matter, Judge...

[redacted], recused himself from this matter on July 15, 2016. The case has been reassigned to Judge [redacted]. There are two motions currently pending before the Court. On March 4, 2015, Plaintiffs filed a Motion for Class Certification and on October 22, 2014, Defendants filed a Motion for Summary Judgment. Since then, the Parties have routinely updated the Court with recent decisions that they believe will impact the outcome of the two pending motions. On April 4, 2016, Judge [redacted] asked the Parties to submit supplemental briefing incorporating the information submitted by the Parties. The Parties submitted supplemental briefs, concluding their briefing on June 6, 2016. The new schedule and reassignment likely means that the Court will not issue a decision on either motion until Fall 2016 at the earliest. We will keep you apprised of any developments."WE HAVE BEEN WORKING CLOSELY WITH OUR LAW FIRM IN AN ATTEMPT TO HOLD THE SHINGLE MANUFACTURER RESPONSIBLE FOR WHAT WE CLEARLY BELIEVE IS AN ISSUE WITH THEIR SHINGLES. THE COMMENTS ABOUT THE SHINGLES BEING INSTALLED INCORRECTLY IS A COMMON PLOY BY THE MANUFACTURER TO SWITCH THE OWNERSHIP OF THE PROBLEM OFF ON THE BUILDERS AND INSTALLERS. IT SHOULD BE NOTED THAT MANY INDEPENDENT INSPECTORS OR ROOFING COMPANIES WHEN INSPECTING A ROOF WITH THESE SHINGLES ON IT WILL AUTOMATICALLY CLAIM IT IS AN INSTALLATION ISSUE BECAUSE THEY DO NOT HAVE THE BACKGROUND INFORMATION ASSOCIATED WITH THE NAIL STRIP AREA SHRINKING IN SIZE AND THE TAR STRIP NOT SEALING DUE TO SOME ISSUE DURING THE MANUFACTURING PROCESS.WE WILL BE IN CONTACT WITH THIS CUSTOMER AS MORE INFORMATION ON THIS MATTER COMES TO FRUITION.

The customer e-mailed me a few times...not everyday for a month and I have already responded to this customer and have answered their questions. Just to shed a little more light on the subject..... the first 90 days of this year, it rained 45 days. This caused some serious challenges to our ability...

to get the foundations dug and installed. Our agreement with every customer has a projected closing date and we are very clear that a projected closing date is by no means an actual closing date ...but, at the same time it is based off of historical data. The house was in mechanicals in June near the time that this customer cancelled the contract. As far as the waterproofing comment goes it was known by us that the grade line was going to be higher and the waterproofing company was going to come back out to spray up higher. There is no way that we would grade over and not waterproof the foundation. We provide warranties on our houses and it would make no sense to do such a thing. We also go through many inspections that require us to following the building code along with our internal quality checks from the warranty department that has a vested interest in making sure it is done correctly. To make such assumptions that we were going to cover up a foundation wall without waterproofing is wrong and defaming in nature and to say I have been e-mail everyday for a month is just not true. I have answered this customers question in a previous e-mail and I am sorry that the house was going to be roughly 4 to 5 weeks behind due to weather.
