I hired Mr. W, attorney for an updated Power of Attorney for my Father who is a Korean War Veteran just admitted to the *** at Stony Brook NY. I paid him in full $1500.00. Due to corona virus lockdown the day after my Dad was admitted, Mr. W never executed the Power of Attorney. My dad has since passed. I attempted to contact him many times via telephone to discuss/negotiate a partial refund for the services never completed. Mr. W never took my calls but sent a letter several weeks later stating his unwillingness to discuss a refund. I have never received any of the paperwork he may have performed which I would gladly negotiate a fair payment.
I feel this is unethical for Mr. W behave in this manner.
On March *, 2020, I met with *** at my office in Commack, NY with regard to a power of attorney for her father, ***. Although I met with ***, she and her sister, ***, were both to be given power of attorney by their father. Two days later, on March , 2020, I agreed to meet *** and her father at the Long Island Veterans Home in Stony Brook, NY approximately 12 miles from my office. I closed my office for this purpose and brought my associate, Michele M, an attorney, as a witness. My administrative assistant was not in the office that day. This was prior to the official shutdown of businesses due to Covid-19. Upon our arrival at the Veterans Home, we were denied access due to Covid-19 concerns. At that time, I explained that if a FUTURE trip to Stony Brook was required, there would be no further fee for travel. Businesses were not mandated to close until the following week. On or about April *, 2020, *** left a voice message letting us know that her father had passed away. Since I was working remotely, I asked my assistant, Virginia Perotti, to phone *** to express condolences and ask if there was anything we could do to help. *** was told no and that she was wondering about a refund. It is not our policy for anyone but me to discuss matters relating to legal fees so *** said she would speak with me about the matter. A very few other voice messages were left, and I responded in writing on April *** and April , 2020 explaining why a refund could not be issued, since I had performed the work for which I was hired on an expedited basis. Please see attached correspondence. A response dated April , 2020 is attached. Please note that *** threatens in her letter to share "the story" via social media and word of mouth. Around the same time, Theresa Haskell asked for a copy of the papers I prepared, although they are of no value now tha*** has passed away. My assistant asked if she could send them to her via email and was told yes. Please see cover email to Theresa Haskell dated May *, 2020. A few days later, having received no response from *** phoned her to ascertain that she received the documents. *** confirmed receipt. It is not the fault of our office that we could not gain entry to the Long Island Veterans Home to meet with *** for the purpose of signing a power of attorney document, statutory gift rider and health care proxy, but all of these documents were prepared in very short order, and my associate and I made the half-hour trip. Later, after ***'s demise, we were, indeed, responsive to ***'s calls via a return call and two letters.
Revdex.com:
I have reviewed the response made by the business in reference to complaint ID# ***, and have determined that my complaint has NOT been resolved because
several of *** statements are untrue.
1. His office did not reach out to me at all at anytime via phone calls I made many calls without any verbal responses The o ly response was a letter several weeks later in which he refused to negotiate at all
2. when I made the initial call I clearly stated I was asking for services not rendered. I feel something was lost in translation from his office person to him. 3. At the time *** came to the facility to meet with my Dad, he said there was no charge and he requested 500.00. I paid him in full because that was the only check I had with me at the time I, in good faith gave it to him.
4. My sister *** never received any calls from his office after she called to speak with him I asked her to call because they were ignoring my calls.
5. Resolving a dispute with an attorney is difficult but I have and will continue to let others know about my experience.
