I visited this gas station on October 13, 2019. The station had a gas spill the night before and it was 11:30 a.m. when I was getting gas. There was no indication that I should not use the pump or that there was any danger in that area. An attendant came over and pumped my gas and said that sometimes the nozzle does not shut off. He did not say there had been gas spilled in the area. A gas spill on wet pavement is very slippery. walking back to get in my car I slipped and fell and broke my wrist and a vertebra in my back. After my fall I told them they should have the area of the spill blocked off and later my husband returned to the station and saw they had orange cones around the area. That should have been done before I fell. it is terrible that the station let a situation occur that was a danger to their customers. The investigator for the Marathon Gas Company stated that I should have been aware of the spill. They take no responsibility. They said that an attendant was standing in front of the pump with a shovel but that is not true as I pulled up to the pump behind another vehicle that pulled up to the pump in front of mine. A video of the incident would show the truth. When a spill occurs from a faulty nozzle the station should shut that pump down until it is fixed. The station did not follow any safety protocols for a spill and did not report the spill to ***.

Other (requires explanation) I would expect compensation for my medical bills, time off of work, and pain and suffering I have experienced due to this injury.
We are in receipt of the complaint submitted by Ms.. Her claim was filed with our carrier, *** for investigation. Since Ms. has hired legal counsel, we feel that it would be more appropriate if her attorney would reach out to our adjuster at ***.

The investigator from *** denied any fault of the business and stated that I should have been aware that there was a gas spill. The pump was open for use and there were no warning signs or cones placed to show there was a danger. It was raining so the gas spill just looked like wet cement. After I fell they put material on the spill to soak up the gasoline and put orange cones around the area. This should have been done before someone was badly injured. The attorney does not want to pursue filing a lawsuit as it is not worth his time but I feel that the business should be held accountable. A business has premise liability and a "duty to care" to ensure a safe environment for their customers. To leave a hazardous area is negligent on their part. The station should have informed *** of the spill and they did not. They did not follow proper safety procedures and protocol for when a gas spill of that magnitude occurred. A business that endangers customers should not be allowed to operate or should provide some kind of compensation.
