On April 22, 2013, MIS Interactive and David S as owner and company representative, signed an agreement with *** to design and create a website for this non-profit organization.

***, in accordance with the contract, paid MIS Interactive an $1800 deposit receiving a pdf mock home page in return. A pdf mock home page which was of no use and in no way made it possible to have the completed, functioning website MIS committed to provide.

Shortly after the contract was signed, and the $1800 paid to MIS, *** received a personal telephone call from David S indicating he, nor anyone in hicould not complete the project and there was no one else in his office who could do so. As stated by Mr. S this breach of contract was due to his own internal company or personal conflicts. Mr. S withdrew from the contracted commitment refusing to complete the project. Additional efforts to communicate with David S or an alternate MIS representative, were ignored.

Therefore, *** has no choice but to demand recovery of the $1800 deposit paid to MIS Interactive for the design and creation of a complete website, not just a pdf document.

*** considers this professional relationship terminated due to an MIS Breach of Contract. As legally advised, we submitted a demand letter to David S and MIS Interactive in March, 2018 requesting a refund of the $1800 deposit and that payment be received in full by April 1, 2018, or our attorney would begin the process to collect $1800 as the amount owed plus interest.

Mr. S replied the legal Statute of Limitations had expired on this contract and that he, and MIS, would, therefore, not be held responsible for this breach.

*** was aware of the Statute of Limitations, but remained hopeful Mr. S would exercise improved moral and professional judgement and offer a settlement for the services never rendered.
