I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.
Los Rancheros HAS to remove any and all transaction fees being accessed to customers! Why? Because it is state law, according to the statues of the state of California, Civil Code, section 1748.1(a), is clearly
states, "No retailer in any sales, service, or lease transaction with a
consumer may impose a surcharge on a cardholder who elects to use a credit card
in lieu of payment by cash, check, or similar means. A retailer may, however,
offer discounts for the purpose of inducing payment by cash, check, or other
means not involving the use of a credit card, provided that the discount is
offered to all prospective buyers."
I would like to hear from Mr. [redacted] about how Los Rancheros is going to remove all transaction fees associated with credit cards AND remove all signage from their property. The law doesn't just apply to large businesses, but small business too!

Review: On March 30, 2014, I visited here to get a carne asada burrito. The cashier told me the price was $5.67. I gave the cashier my credit card and she came back with a receipt that said $6.02. I said, "I thought you just told me that amount was $5.67." To which the cashier replied, "There is a 35 cent credit card transaction fee." I ask the cashier, "Where does it say that?" The cashier then slid the order window glass closed, which revealed a sign that says that all credit card transactions are charged a 35 cent fee. In addition, the cashier asked to see my ID. I told the cashier that this fee was hidden and was plain not right, but she refused to refund me. My receipt clearly shows a credit card transaction fee of $0.35.Per California Civil Code, section 1748.1(a), is clearly states, "No retailer in any sales, service, or lease transaction with a consumer may impose a surcharge on a cardholder who elects to use a credit card in lieu of payment by cash, check, or similar means. A retailer may, however, offer discounts for the purpose of inducing payment by cash, check, or other means not involving the use of a credit card, provided that the discount is offered to all prospective buyers."In addition to the California state law on this matter, accessing a credit card transaction fee is against credit card policies of Mastercard, American Express, and Discover! You cannot charge the customer a transaction fee for them using their credit card!Desired Settlement: A refund of $0.35 for the credit card transaction fee I was assessed!
