LRE has sent maintenance technicians on multiple occasions to Mr. [redacted]'s apartment to try and address this issue. They have never found evidence of smoke inside his home but still took preventive measures to eliminate any possible infiltration. They foam sealed the penetration where the...

sump pump discharge line comes thru the wall as well as caulking any noticeable cracks in the basement / crawl space areas. Mr. [redacted]'s statement that LRE does not care is completely untrue. Each time he has requested us to come out we have sent staff to investigate. Each visit yielded novisible evidence of cigarette smoke passing from the unit next door into his apartment.There are no smoking restrictions in Mr. [redacted]'s lease nor do we advertise any of our properties as being smoke free. Currently there are no state wide laws in Ohio prohibiting smoking in apartments or condo's. It is up to the individual property owner/manager whether to have a no smoking policy or smoking restrictions in place. Unfortunately, transferring Mr. [redacted] to a different apartment could potentially lead to a similar problem.  LRE is willing to let Mr. [redacted] out of his lease agreement provided a 30-day written notice.
