Then [redacted] hassomeone else call me and tell me I wasn't approved due to my income. I am a senior citizen living on afixed income of $2024 state retirement and $264 after Medicare $104.90 = $159. So my total income is$2288 plus almost $1000 I earned from Express Professionals last year (2014) and a little less from theyear before (2013). I ALREADY MAKE PAYMENT OF $875 A MONTH ON MY HOUSE NOTE. THE NOTEWITH LOAN DEPOT WOULD HAVE BEEN AROUND $626. NOW IF I HAVENT MISSED A NOTE OF $875, ISURELY WOULDNT MISS A NOTE OF $626. Borrower states that she was lead to believe the loan was approved until she was charged for theappraisal deposit fee of $200.00.2. Borrower states dissatisfaction with the services received.3. Borrower claims loanDepot has taken advantage of a US citizen. loanDepot Findings and Response:1. After a review of Ms. [redacted]’s loan, the borrower was initially locked in to a 5.125% FHA Fixed 30Year loan on March 12, 2015. loanDepot sent your welcome package on the same day with allrequired documents to be executed prior to the processing of the loan product chosen. 2. As a customer concession, Ms. [redacted] was only charged $200, rather than $395 for the purpose ofan appraisal fee which is collected by credit card. Prior to collecting this fee, loanDepot evaluates thecustomer’s needs and determines if they have a loan product that will help the customer. Thecompany conducts an extensive screening process on the phone with the customer to collect dataand find the proper program that will fit the customer’s needs. loanDepot then emails the customerinformation about moving forward with the loan. Ms. [redacted] executed the Appraisal Fee Agreement on March 17, 2015 where she acknowledged:“The Appraisal Fee of $200.00 is non-refundable if an appraisal has been completed on the subjectproperty. If an appraisal has been completed on the subject property and you cancel yourapplication, you will not receive a refund of this appraisal fee. If your application is declined, even ifthe appraised value is not what you expected, and an appraisal has been completed, you will notreceive a refund of this appraisal deposit. The appraisal deposit will be held in trust until eitherrefunded to you, if applicable, or withdrawn to pay the appraisal management company.”Based off of this and because the appraisal was completed, a refund of $200 is respectfully declined.Attached is the completed appraisal report for Ms. [redacted]’s property.In conclusion, loanDepot sincerely apologizes that Ms. [redacted]’s experience with loanDepot wasanything less than satisfactory. We attempted to assist Ms. [redacted] with her loan request as much aspossible, but ultimately the loan was declined due to debt to income ratio on April 28, 2015. Based off ofthis and according to the terms executed on the attached Appraisal Fee Agreement, a refund of $395 isnot warranted. the customer has felt frustration in finding a way to lower their mortgage payments. We apologize for any difficulties our customer may have experienced in their attempts to reach our Loss Mitigation Department. We know that homeownership is important to many families, and we are very sorry for the loss of their loved one. We sincerely regret any misunderstandings. Our customer mentioned that they are in an area prone to storms, and flooding. This can add to our customer’s worries, and we want to alleviate any stress for our customer. Customer Service is our priority at all times. According to our records, the customers were previously granted disaster forbearance on August 30, 2016, which was extended to July 1, 2017. This was the reason they were denied for a modification on April 2017. The customer was not denied for any other reason, it was due to already being on an active forbearance plan. However, when the forbearance plan ended, they were reviewed for a loan modification within 30 days. This resulted in an approved modification trial plan. The customer was informed August 17, 2017 that they were approved for a FHA Standard Modification trial. The trial period offers payment relief, and ensures that the customer can manage the new payments. Trial payments of $1,960.97 are due on October 1, November 1, and December 1, 2017. The existing loan terms remain unchanged during this trial period. If the trial is successfully completed, and the customer’s remains eligible, a modification agreement will be sent. Once the loan is modified, the interest rate will be fixed for the life of the mortgage.loanDepot will always do the right thing for the customer. We have taken the steps, to address any opportunities to improve communication, going forward with our associates and the customers. estimate of time for processing. This estimated time can be affected by many factors. Some of these factors are beyond our control.A review of recording for the call conducted on June 6, 2017 revealed that our associate informed the customer that the appraisal deposit of $450 would be refunded as a lender credit at the closing of the loan. However, the loan was declined due to circumstances beyond our control. Further review of the call recording confirmed that the customer was advised that the loan was approved by the system based on the verbal information provided. Supporting documents to substantiate the stated information will be forwarded to the underwriter for final or conditional approval.On June 28, 2017, our processing team contacted the customer regarding derogatory information being reported by their previous lender. We placed the loan process on hold to allow the customer time to get any inaccuracies corrected. On August 1, 2017, we provided alternate loan program options; however, the customer was unable to provide necessary documentation that showed the unfavorable information removed.The appraisal deposit in its entirety is paid to a non-affiliated appraisal management company. loanDepot does not profit from the appraisal deposit. We regret that we were unable to meet the customer’s financial objectives. For these reasons, we respectfully deny the customer’s request for a refund.
This letter is in response to your inquiry dated 2/27/17 regarding the above-referenced Loans (“the Loans”). According to our records, on March 7, 2017 both Loans were transferred to our mortgage servicing division in New Jersey. Prior to the transfer, electronic funds in the amount of $811.56 and $815.47 were received from [redacted] CheckFree (“CheckFree”), a third party web bill payment service provider. At the time of receipt the electronic funds could not be associated to the loans and were allocated for return to CheckFree. The March 2017 installments reflected past due resulting in collection calls on March 13 and March 17, 2017. On March 20, 2017, the borrower contacted our office in response to the calls and advised that payments were previously remitted for both Loans. It was requested that the borrower submit bank transmittal summaries so the funds could be traced. On March 23, 2017, the transmittal summaries were received and research was initiated. Regrettably, appropriate loan maintenance was not completed to suppress collection activity while research was underway and additional collection calls took place on March 27 and April 5, 2017. During our research it was discovered what occurred with the unidentified funds and that they were returned to CheckFree on March 22, 2017. The borrower subsequently confirmed the return of the funds to his bank account. As of the date of this letter, the Loan is current and there were no late charges assessed or adverse credit reporting. We apologize for the inadvertent collections calls and any resulting concern the borrower may have experienced. We have accommodated the borrower’s request for compensation in the amount of $200.00 via check numbered [redacted] and look forward to earning his confidence in our ability to provide a high level of customer service. This is completely untrue and the laws of the lending industry were violated. Although one of the employees you referenced is no longer employed, [redacted] is still employed and violated fair trading practices, not to mention incompetent. Loan Depot is responsible, refuses to take ownership in any way other than to verbally admit that they made a mistake. As communicated before, this will be sent to the Attorney Generals office.

As per the terms of that agreement, Loan Depot agreed to never contact me again by any manner,ie., mail, telephone, etc. In exchange for that, I would drop the complaint. I met my part of the agreement. However, they still contact me or my wife, [redacted], approximately twice a month by mail. I have sent much of it back to them with no results. Finally, I broke down and called them yesterday. The person said there was nothing he could do and just kept reminding me that they had an A + Revdex.com rating. How they have an A+ rating is certainly a mystery to me. Any way, I want this to stop. These are, in my opinion, terrible people who do not mind harassing senior citizens. the appraisals on their customers. We are not allowed to influence any part of the appraisal process. We understand that every customer has a certain assertion about the value of their home. Home ownership is something to feel proud about, and that carries a lot meaning for people. There are so many factors that go into determining the value of a property. Several factors, often beyond the control of both the customer and the lender, can affect the value. We use only reputable appraisal companies, with licensed appraisers, to provide quality to our customers. We understand that our customer did not agree with the value of the appraisal result. We offered the appeal option to our customer. The appeal was declined and no change was made to the original result. The Sales Manager called our customer to go over the appraisal and the appeal results in detail. During this call, the customer requested the refund of the appraisal deposit because she was taking her business elsewhere. Her request was declined because services had been rendered. The customer advised that she wanted to cancel her application. The Sales Manager complied with the customer’s request and closed out the file. Our customer can have her FHA appraisal report transferred to another lender if she wishes, it is her discretion. We regret that our customer was not satisfied with the appraisal results. contacted them online...WHICH WE DID NOT. He spoke to them on the phone and did not give them any permission to send any documents. THIS IS THE SECOND time they send loan documents to our rural address with no signature required. These loan documents contained all of our personal info including our SSN and DOB. I am not even sure how they got my SSN since my husband does not even have it memorized and I sure the hell did not give it to them. THIS IS UNACCEPTABLE. Something needs to be done ASAP to stop this horrible practice. Anyone could (and does) steal this info out of our mail box and we would have to deal with the issue of stolen identity. rate of 2.375% and has a (1)disclaimer, but not disclaimer is actually disclosed on the notice. I called to get a quote for an FHA streamlinerefinance. I reached [redacted]. He read a disclosure that there will be no steering (of me towards a product). Hegathered all my information, ran my credit and then quoted me a Lender Paid MI Conventional of 4.5%. He quotedan effective rate on my current loan of 5.5% with the MI. That is a deceptive practice since he knew that my currentloan included FHA MIP; which as a mortgage consultant should know that MIP is eligible for termination after 5years (not life of loan). He then hesitated to quote me a rate for an FHA Streamline refinance and said the LenderPaid MI is my best option. After pushing more to quote the streamline refinance, he then quoted an FHA loan of4.5% for 30 years (ran it based on my original loan amount, not my current balance). He was absolutely steering meinto the Lender Paid MI. I believe he was being deceptive and misleading.Borrower’s Desired Resolution:I would like an investigation into loanDepot for deceptive practices and steering. At that time, Ms. [redacted] further inquired about otherloan products available she may qualify for, specifically information pertaining to an FHA Streamlineloan product. The LLO continued by providing the possible benefits for an FHA Streamline product.In reviewing said loan product it was discovered that this particular loan type would only save Ms.[redacted] approximately $50.00 a month. The Licensed Lending Officer then advised that this wouldnot meet the requirement of reducing the payment by 5%, thus disqualifying Ms. [redacted] for an FHAStreamline loan. loanDepot apologizes that Ms. [redacted] felt she was steered to a specific loan product, howeverloanDepot quoted all loan products that Ms. [redacted] was interested in and qualified for. 2. loanDepot has added Ms. [redacted]’s information to the Do Not Mail and Do Not Call list so that sheno longer receives any communication from loanDepot as requested. Started working with LoanDepot on my loan in the beginning
of Oct 8 and explained my living situation and was told I am fine with my
homeowner application to FHA streamline. LoanDepot started the processing and
was told 4 weeks into the processing that I don't qualify and my rate rise by
.25 bases point without anyone telling me. I had to ask them to explain the
items line by line to find out the reason for the increase. The large lender
credit is also misleading because it included requirement of your own
"post dated escrow check" (this is your own money that you need to
payback them at closing). It took until early-December for all the issues to
resolve and I had to be involved every step of the way because no one is really
informing me of the changes. The closing date had to be pushed back and I was
forced to pay an additional $2000 for the rate re-lock fee. To make it worse,
they "had to" force me to sign the paperwork while I am on vacation
in Hawaii because the loan was delayed so much and so I don't get another
re-lock fee. It took a total of 63 days for the FHA Streamline loan. There is
no excuse for that. To give an example of the lack of care for service, I did
request waiver of the rate re-lock fee and the service rep actually told me in
a email that she was able to get that waived. Good until the loan officer
called me back and said that is in "error", and in discussion with
upper management they had to rescind the waiver because they be losing money.
No one really care, communicated, informed or put any thoughts into this loan process
and let this become a nightmare. I lost many nights of sleep because terms keep
changing; my rates changed from 3.625 to 3.875; discovered lender credit is not
really fully lender paid credit; $2000+ rate re-lock fee. I am so unhappy with
this loan but forced to sign because really have no other choice. If I can't
get a resolution on Revdex.com, I would likely to file a complain with Consumer
Financial Protection Agency.

After a review of Mr. [redacted]’s loan, the borrower
was initially locked in to a 3.625% FHA Fixed 30 Year loan on October 8, 2015.
Once loanDepot collected all of the required information for a complete loan
application, the file was sent to processing on October 13, 2015 to obtain all
required financials in order to submit to underwriting for conditional
approval. After a review of the financials provided, loanDepot discovered that
the addresses differed on all documentation which prevented the property type
being the primary residence. At that time, loanDepot changed the property type
to an investment causing the rate to increase to 3.875%. The file was submitted
to underwriting on October 22, 2015 and we received conditional approval the
same day. The outstanding conditions were communicated to Mr. [redacted], once
loanDepot was able to connect with him on November 3, 2015. A loan estimate was
provided to Mr. [redacted] on November 9, 2015, in which he did not agree with the
change in interest rate. On November 13, 2015 loanDepot discussed the loan and
reason for the rate increase, and Mr. [redacted] agreed and proceeded with the loan. We received final approval on December 7, 2015
and the loan successfully funded on December 11, 2015.
In conclusion, loanDepot sincerely apologizes
that Mr. [redacted]’s experience with loanDepot was anything less than satisfactory.
We attempted to assist Mr. [redacted] with his loan while facing many challenges, and
successfully funded the loan on December 11, 2015. Unfortunately, we are unable
to honor Mr. [redacted]’s request.

The fact that [redacted] couldn't reach me, is irrelevant to the whole scenario. YES, I accidently blocked him. Therefore, he was not able to relate to me that he never should have told me this was a "done deal" and we were qualified. Again, I told [redacted] we would be running up our credit cards for Christmas, knowing they would be paid with this cash out loan, that apparently, never should have been approved in the first place. When we went to PLAN B for the second mortgage, we were rejected for the "lack of 24 month mortgage rating". We had already established over 1 and a half years on the exisiting mortgage, and prior to us moving into this house, [redacted] lived with his monther-in-law for 5 years. He paid rent to her for 5 years, but the last 4 months in the house, she let him skip his rent to save for this house we moved into. We offered Loan Depot a letter from that landlord explaining this, but were denied. SO, what does Loan Depot do when someone comes to them for a first time mortgage, just moving out of their parents house? Or with someone that just went through a divorce and lived with a family member so hase no rental history, but totally qualifies for the loan? They deny them for a 4 month rental payment payment gap? Are you serious? I don't even think that this is even one of their requirements, and here is why....we received the decline letter, and the reason for decline was marked off at the bottom (MANUALLY TYPED IN). On this denial letter, there are 23 COMMON REASONS for a loan rejection, OUR REASON is because they made it up. Clearly. It was typed in. I've attached that letter they sent. Someone else messed up through this process. They needed to find a reason to give us, not being the true reason. SO, after ALL of this, someone from customer service calls us to try and see what she can do to rectify this. Her reason for calling is "because there was a complaint made from us on the Revdex.com). She acted as if she wanted to help us, but then rejected again. WHY??? Because we didn't have 3 months "reserves" in the bank, and a FICO score under 720. WHY does he have a FICO score of under 720? Because the Loan Depot ran his credit a total of 4 TIMES, with only a ONE TIME permission given. WHY don't we have 3 months reserves in the bank??? Because we had to tap into it to PAY ALL THE CREDIT CARD BILLS THAT CAME IN after we were told the original loan would pay them off. This company is unbelievable, and I have already looked into some legal actions I can take. DO NOT go to Loan Depot for your needs. They will financially screw you over, as they did us!

First , loan depot solicited me and assured me that I would qualify for the type of refinance that I wanted. I have emails supporting this. 2) I specifically stated I would only consider a new loan at the quoted rate without a co signer 3) Based on the info / documentation you had it was communicated that I was qualified. 4) loan depot stated that this was a no income verification process , I was told loan depot was getting $2,500 from the government for this loan . 5) loan depot was given personal financial data ( sent by certified mail not screen shot) and continually claimed they did not receive the same data over and over. In addition they continually asked for information that was on my fathers application that they already had in hand . Then I was harassed demanding more personal information which they claim they needed to try and get a refi loan that had already been informed at the beginning that I told them I didn't want. Loan depot after telling me there was no income verification notified my employment requesting the information. The gist of my complaint is that Loan depot uses unfair trade practices by claiming to offer a product , lower interest rate, no co signer required no income verification when they knew I would not qualify. Their response to Revdex.com stated that they were trying hard to get me a loan when I told them from the beginning that I did not want. At no time did loan depot ever tell me that I did not qualify for the loan they originally offered me. They sent correspondence congratulating me which is contradicting. I had to track down the sales manager only to be told that the loan officer who originally contacted me was " allegedly" no longer with the company. After the original loan officer correspondence was not answered repeatedly. I did not respond to loan depot after Brian Kelly ( manager ) responded to me, admitting there was wrong doing on loan depots part however rudely ended the conversation telling me " it is what it is" and there was nothing I could do about the unfair practices I was victim to. ( hopefully conversation is recorded as stated on the phone ) this is a classical Bait and switch misrepresentation by Loan Depot. Please note this may be sent to Attorney Generals Office as well.
After a review of our systems, there was a conversation
between the borrower and loanDepot’s servicing department on February 18, 2016.
On February 22, 2016, Servicing reviewed the email the borrower sent her
regarding the website. This email does not confirm proof of payment, but it
only...
provides information on how much the payment would cost if the borrower
made a payment via mobile. On February 23, 2016, the borrower spoke with a
supervisor in the Servicing department who advised Ms. [redacted] that she was
trying to make her payment after the cut off time (9pm Eastern Standard Time)
and have already waived 2 late fees previously for October and the November
late payments. The borrower was assessed a late fee because her payment was
received on the 18th of the month. Based off of this, loanDepot will
not be reimbursing the borrower the late fee.
loanDepot sincerely apologizes that Ms. [redacted]’s
experience regarding the servicing of your loan has been anything less than
satisfactory. Here at loanDepot, we have established responsible lending and
customer service as our core values.

I do not have a physical address for deleveries. I have a P.O. Box [redacted]. I was told more than once by different Loan Depot representatives that I would receive the paid in full letter by email for this reason. I have received no email nor any mail from Loan Depot. All I am asking for is an email stating my account is paid in full and showing my account balance is $0.00. [Their response is inaccurate. The experienced loan officer told me on a recorded line that I will have no problem with approval. When I asked why it was rejected after the appraisal (witch was higher than needed) she told me point blank that she was not aware of the alimony that was plainly listed on the declaration page. They obviously did not review the recorded line to see that this was the fact I was responding to. They are taking advantage of unsuspecting clients to get business to appraisers or whom ever. I am in no way happy with their response.]

I am not satisfied with this company and will tell everyone I know not to do business with your company . You scam poor people out of their money and that is how your company works. I know what I heard from your employee and I am consulting a lawyer in regards to filing a suit against loan depot for false advertising and knowing about my financial situation where I would not qualify for a refinance before my money was taken. Your company is a setup to give people false hope and steal money.
