Review: Liberty Elevator has been our provider for a year or so. We have an agreement with them to keep our elevator in good working condition and safe. However due to their negligence and bad work ethic we failed our 5 year State inspection due to simple things that should have been spotted and brought up to our attention so we could correct it, that never happened and the day of inspection we were notified by failing the inspection. We had to look for another service provider to start resolving the issues with our elevator. Liberty Elevator should not bill us for something that was totally handled unprofessionally and due to that led us to acquire additional costs.Desired Settlement: We no longer want to do business with them, and would like for their company to void any open invoices that stemmed from this issue.

Review: Liberty Elevator overbilled in 3 cases:
$2204.73 for work not performed between 2/2013-10/2013.
$800 for an inspection done on 12/**/2012 that was already paid.
$278.72 for purchasing violations on 2/**/2013 that was not approved.Desired Settlement: The desired outcome is a removal of these charges and removal of the mechanical lien.

The customer requested the work done by our company. The service was provided and [redacted] has refused to pay for the services or any sales tax on the work performed inspite of our repeated attempts. He also retained our services to correct his safety violations with the City of New York. All work was performed and filed with the NYC Department of Building. All work orders and filings with the City of New York can be provided for your review.

We have paid for every service provided by Liberty that was agreed upon, including sales tax, which have included the correction of safety violations, maintenance as well as repairs and we can provide proof of payment for your review. We are disputing less than 10% of the overall charges that have been already paid for, that involve services that were either not provided, not agreed on beforehand or already paid.
The specific charges where Liberty Elevator overbilled were in 3 cases:
a) $2204.73 for maintenance not performed between 2/2013-10/2013.
b) $800 for an inspection done on 12/**/2012 that was already paid.
c) $278.72 for purchasing violations on 2/**/2013 that were not approved.

I have reviewed the response made by the business in reference to complaint ID# [redacted], and have determined that my complaint has NOT been resolved because:
The
3 items we dispute have not been addressed on the latest response
from Liberty.
a)
Reference [redacted] in the statement for $278.72 (Purchased 7 violations
from DOB) dated 2/**/2013. This expense was not approved. The
proposal Re:Cat 1 work was dated 7/**/2013 and the invoice is from
2/**/2013. How could we approve an expense that had already taken
place?
b)
Reference 230144 in the statement for $800 (Performed Category 1
inspection) dated 12/**/2012 has been replaced by Reference [redacted]12/**/2013 Performed Category 1 inspection for 2013 $925.44. However,
the proposal Liberty sent on 7/3/2013 which is titled Re:Cat 1 states
that it includes the Category 5 test.
c)
Reference 230308 (2/**/13), 230417 (3/**/2014), [redacted] (4/**/2013),
[redacted](5/**/2013), **(6/**/2013), [redacted](7/**/2013), [redacted](8/1/2013), [redacted](9/**/2013), [redacted](10/**/2013) for a total of
$2204.73 for maintenance not performed between 2/2013-10/2013.
Furthermore after we started this dispute we checked the logs and
there are no visits registered for the months after 10/2013. We are
not disputing the months after 10/2013, all we are asking is to get
credited for the months we did not have maintenance.
Once
again we are asking Liberty to remove the 3 disputed items (a, b and c) from the
statement $278.72 + $925.44 + $2204.73. There were several abuses done by Liberty which we outlined in our previous responses. At this point we do not wish to press on with any of the abuses commited against us as customers. We obviously won't recommend Liberty to other [redacted] but we won't say anything negative about Liberty as a company if we are able to reach an agreement. We hope that these disputed
items are taken into account and that our proposed resolution is
heard so that we can part ways in good terms.
