Complaint: ***I am rejecting this response because:
On March 11, 2016, David D*** who works in the Lexar Corporate office informed me that he had met with Tracy and she had agreed to refund $of our depositThis check has still not been sent to us and we are awaiting it
In their meeting, Tracy told David that our financial situation had changed and that was partially why we couldn't build with LexarThis is entirely untrue, as nothing has changed for us financiallyThe only thing that made us unable to build with Lexar is this drastic price increase.
I understand that price increases do need to happen from time to time, but when a price increase like this is sent out, it's good customer service to at least refund the depositTracy's Lexar office has shown terrible customer service and I would not recommend this builderWe are still awaiting the partial refund David told us Tracy agreed to
Sincerely,*** ***

In response to Complaint ID *** Lexar Homes will not refund the non-refundable deposit to *** and *** ***They signed our contract on 8/17/and paid the $non-refundable deposit to be used to purchase their engineered set of plansThey were informed and aware this is in the
contract
The ***’s received their set of engineered plans and used them for appraisals and was also available for permittingWhen their engineered plans were ready to pick up on September 16, 2015, *** instructed us to have Walker Construction to pick them up and start on the permitsSo they were fully aware the plans were ready and available two months prior to receiving the price increase
Despite stating in good faith, in an email to *** on January 11, that the price is good for days, we issued a price increase to the ***’s at days because so many of our subcontractor and supplier costs to build a home had increased that we felt the need to inform our customer as soon as possibleHad we not given them the price increase at days, they would have received it at daysStill the contract price remains in effect for days from the Agreement provided construction startsYet they were still a long way from starting at days because permitting had not even started
Lexar Homes has to adjust its prices based on industry changes and these cost increases happen to add up to a lotThe fact that the ***’s are unable to build because of the price increase they received is an unfair statement about usHow is the builder to know if it wasn’t some other factor that makes them unable to build? Yet they tell us they understand construction cost increases and still expect us to lose money on building a home that was purchased over months agoThe refund is denied because the engineered plans they paid for were received and used for appraisals
Sincerely,
Lexar Homes of Snohomish

Complaint ID [redacted]

Lexar Homes is rejecting the consumer response because:

The offer to refund $1000 was contingent on [redacted] and [redacted] removing the Revdex.com complaint. They refused this offer on March 14th and asked for $2000 before removing the Revdex.com complaint, which we did not agree to. [redacted] even stated to David that “I don't want to have any hard feelings with Lexar and as soon as Tracey refunds us what I've requested, I'll immediately remove my complaint from the Revdex.com”. But [redacted] is now defaming our name and the service that we’ve provided to them and wants a refund for these false accusations while keeping this complaint in place.

We provide exceptional customer service to everyone we work with to assist them in getting a new home built, including the [redacted]’s. We’ve reviewed the building process with them, referred an excellent lender, provided documents to their lender, referred a site work contractor, encouraged them to get started right away on their permitting and financing to avoid possible price increases, met with her/them many times in person, talked about changes they can make, even about upgrading their cabinets after receiving the price increase. So its obvious that we don’t have an issue with our customer service. She just wants her non-refundable deposit back but will not be refunded because they have received their set of engineered plans..

Sincerely,

Lexar Homes of Snohomish

Initial Business Response /* (1000, 14, 2015/09/22) */
We are working with the homeowners on the items that are construction related, some have to do with landscaping.
Although not all but many of the issues have been taken care of.
Initial Consumer Rebuttal /* (3000, 16, 2015/09/30)...

*/
(The consumer indicated he/she DID NOT accept the response from the business.)
There are a lot of outstanding issues and items that still need repair. We have contacted Lexar with the list multiple times. Some of these items include:
-New firedoor that was damaged during the course of construction
-New front door (I have had to keep a towel in front of each time it rains)
-Sheetrock in the garage and repair inside the house
-New light fixtures (as we didnt like the ones installed and on final walk thru were promised new ones)
-Interior Door adjustments as some will not close
-Siding repairs
-Missing shingles
-Basement window seal (as plywood is sticking out and water leaks in)
I am unwilling to resolve until these items are taken care of in their entirety. So many of these things should not take 5 months to take care of.
Final Business Response /* (4000, 21, 2015/10/22) */
Lexar met with the customer October 16, 2015 got a complete list of what they feel are items to be fixed.
Lexar is beginning work on the list next week.
Final Consumer Response /* (3000, 23, 2015/11/01) */
(The consumer indicated he/she DID NOT accept the response from the business.)
Lexar home was out here to get another list of items needing repair (this had been given to them in the past). Lexar wrote down two weeks worth of my husbands shift working schedule. I attempted to give them the whole rest of the years but they said they would be done in the two weeks. So far one contractor came two weeks after the meeting on a day my husband was working night trying to sleep.
I understand that contractors are busy this time of year and some of the items are not "urgent". I just get frustrated with all the "promises" we receive time and time again about when things will be completed. I will resolve when the urgent items on my list are completed. Those being the exposed wood below the siding all the way around the house and basement windows and the leaking doors. The rest I will allow to be done between now and my warrenty term.
