I have attached the contract that was signed by *** ***. We did note on the account that we changed the cans and kept it at the same price. They were receiving gallon trash and gal recycle for the price of $18.00/month. We started picking the customer 12/3/and ended
on $1/7/16. She did call and want to cancel the service. We explained that they were in a contract and that we had kept our end of the contract. If she did still want to cancel that there would be a early termination fee of $That was on 1/7/16. We sent the invoice twice and made calls to get that payment. We reveived no response from them. Finally on 7/20/we sent the account to collections. That amount included the $plus $40.50(fee the collection service charges) for a total of $175.50. *** did call 7/28/16. She spoke to me (Ali *** Office Manager), She disputed the fact that she should have to pay the collection amount. She stated that we did not get her the correct cans, missed her ect. She did ask to speak to the Owner, I did not laugh at her. I told her that I would talk to him because it was out of my control to take it out of collections. I talked to the owner and he said that he would be willing to settle for half. I called her back and stated that the owner was willing to settle for $87.75. *** said that she was not going to pay that. I then told her that it would stay in collections for the full amount. We have tried to work with them and even settle for half the cost. In the agreement that was signed it does state that if the customer breeches the agreement that they would be responsible for the remainder of the agreement. That cost could have been $

Initial Business Response /* (1000, 5, 2015/10/27) */
All agreement are in carbon copy and signed and dated at the time of the sale. The copy of the agreement is left with the customer. I have looked at the customers account and no notes are on the account stating that they called and were...
looking for a copy of the agreement. Lepage & Sons get charged $135 per customer to dump yard waste. We only charge each customer $70 for the year. you will see on the agreement that yard waste is not noted. we gave it to them for free the remainder of the year. All of the customer service reps are trained in what is detailed in the agreement and we would always do what ever it would it would take to make the customer happy. In the agreement it is clearly noted that it is a 36 month agreement and if you wish to break the agreement early the customer is responsible for the expenses. I have attached the agreement for the records.
Initial Consumer Rebuttal /* (3000, 7, 2015/11/03) */
(The consumer indicated he/she DID NOT accept the response from the business.)
To this date (11/2/15) we have NOT received a contract despite two different phone calls. Our complaint is not necessarily with Lepage, but with the salesperson and his misleading pitch. We were told we would get a free year of yard waste. There was no "free year" as we'd already paid another company for that service. Lepage simply picked up that service up and didn't charge us a second time. He also stated we'd get three months free which, in essence, we did get, but again, misleading, it's charged at different rates for different parts of the year. Its the sales pitch that's misleading and needs to be more defined, at least with the salesperson (Jeff) that we dealt with. Again, we've still not received a signed contract with Lepage as Jeff told us it would be mailed to us after July 4th. I was also told in September that i'd be sent a contract. Still have not received it. Our issue is with full disclosure of our contract. To date, we have no knowledge of full disclosure and, had we known the actual terms of the contract, we'd have known we had 24 hours to cancel a service to which we feel we were misled.
We at Lepage & Sons takes great pride in our customer service. We took every call from this customer with the up most importance. We always went back and took care of what was missed. We tried in everyway possible to make the customer happy. When the customer did decide...
to cancel his service, we cut the check and mailed it on the very same day(11/1/16). For reasons that I cannot explain the Bethel Post office returned the envelope to us on 11/7/16. I re-mailed the check in a hand written envelope on 11/7/16. I tried to explain to the customer that I don't have a reason/explanation as to why it was returned to us. He said that he had been dealing with this for weeks and that he was going to file a report with the Revdex.com. I am not sure what else Lepage & Sons can do to resolve this issue.
I am rejecting this response because:
