To Whom it May Concern,
I am writing you in regards to the complaint filed by *** *** regarding the stop payment fee .The refund check was mailed to *** ***'s then current address, along with his final settlementstatementThis was never returned to us by the USPS and had this been returned
to us, we would havecontacted the customer*** *** did contact our office after receiving the letter we sent to himregarding the outstanding checkAfter the assistant spoke to him, he said he would look again and nevercontacted us backA stop payment was placed on the check, and issued him another check for the balance.We are licensed under RCW 18.44, and are required to send notifications to the customer on anytransactions which have stale dated checksIf we do not hear from the customer within the time framestated, which is days, funds are sent to Washington State Department of Revenue, Unclaimed PropertySection, and the stop payment fees are deducted and reported to Washington State Department of Revenueat the time checks are sentWe cannot just reissue without stopping paymentChecks are issued underour Trust Account, which is monitored by Washington State Department of Financial Institutions and weare required to issue reports Quarterly to the state to insure we are performing in accordance with ourlicensing regulations.As part of our Escrow Instructions signed by *** *** it does state that "Pursuant to WAC 208-690-0040, Leo Palmer Escrow may be charging for miscellaneous services related to the transaction, includingbut not limited to courier, fax, wire, bank service fees, stop payment fees, overnight mail fees and copies ofdocuments"
