We take note of the fact that [redacted]s" (1) cannot provide any proof that he delivered the stated services, (2) cannot provide any written agreement for the alleged 'lifetime' service, and (3) is not disputing the fact that he misrepresented his identity in order to entice Ms. [redacted] to pay $1,000. He also claims to have written authorization for an e-transaction, but he has not produced that authorization document.
Not only did [redacted]s" provide defective and/or unnecessary IT services, but he also engaged in deceptive commercial practices, false advertising, identity fraud and fraudulent inducement. Fraudulent inducement prevents the formation of a contract. In the absence of an enforceable commercial agreement, [redacted]s" must forfeit the $1,000 since he has no legal entitlement to this amount. Should Mr. [redacted] keep the proceeds he obtained through fraudulent means, we may consider his refusal as theft.
Unless [redacted]s" immediately refunds the full amount to Ms. [redacted], we will escalate our complaint to the [redacted], Office of Consumer Protection.
