Lending Club must have the name and address as it appears on the mailer in order to ensure that a consumer no longer receives direct mail solicitations

Checking rates for a loan through the Lending Club marketplace does not impact a consumer's credit score because it results in a "soft" credit inquiry. Unlike a "hard" credit inquiry, which may be visible to future creditors, a soft inquiry does not negatively impact a consumer's credit score and can only be seen by the owner of the credit profile.
In order to determine potential loan offers and rates, Lending Club must be able to access an applicant's credit profile. Therefore, every consumer requesting a loan through Lending Club must authorize WebBank and Lending Club to obtain consumer reports and related information from one or more consumer reporting agencies, such as TransUnion, Experian, and Equifax. Lending Club will not process a loan request without the [redacted]'s full authorization.
When Mr. [redacted] submitted an online loan request through Lending Club, he agreed to Lending Club's Terms of Use (https://www.lendingclub.com/info/terms-of-use.action) and Credit Profile Authorization (https://www.lendingclub.com/info/borrower-credit-profile-authorization.action) through electronic signature. This allowed Lending Club to obtain his credit profile, which resulted in the soft credit inquiry. Again, this inquiry will not have a negative effect on his credit.

Lending Club uses information provided by credit bureaus, including credit score, outstanding debt, payment history, and recent credit activity, to identify potential borrowers and send pre-approved loan offers. As part of the application process, Lending Club may perform income verification to validate the income stated on the loan application. Lending Club requested documentation from the consumer to verify her stated personal annual income. Documentation was not received and, therefore, could not be verified.
Loans originated through the Lending Club platform are underwritten and made by WebBank, Salt Lake City, UT, member FDIC. Lending Club provided an adverse action notification to Ms. [redacted] describing the credit decision on behalf of WebBank. She can view the adverse action letter by logging into her Lending Club account.
To comply with Ms. [redacted]'s request, Lending Club has removed her name, address, and email from our marketing list. To the extent that Ms. [redacted] has previous applications or loans, Lending Club is required to keep records in accordance with the requirements of both federal and state law. We are unable to remove such information from our records database until such time that the required record retention period expires. This information can be viewed in our Privacy Policy on our website.

It is fine that the Lending Club sends out "you are pre-approved" mailers. But they need to specify with some sort of notation as they do with their interest rate by putting an asterisk besides the the percentage rate that they print on their same mailer. They do not indicate that with the "you are pre-approved" statement. My wife could not verify her income as we later went through the application and if we knew that from the beginning to verify income then the application would never have been started from the beginning and give out her personal information. To us this is misleading and it needs to be change in the printing of their mailer so other people are not misled or misguided and also give out their personal information. This is not right.

I would like to add that the Lending Club previously stated that they look at the client's income to verify the "possible" loan, which is fine on their part, but this is NOT PRE-APPROVED. Their advertisement was and is misleading They should of had some sort of notation by the "pre-approved" statement as they do for their loan percentage rate!!! I only hope they can "improve our [redacted]" statement. If they can guarantee to this significant change in their advertisement then I can be satisfied and for all their future customers!

The quickest loan I have ever taken out. Including weekend/holiday the loan funded in 14 days. Called to ask a question and the person was friendly and helpful. He also wanted to make sure I understood everything and thanked me for my call. The statement others have made about not disclosing a fee is absolutely false. It is clearly stated in the application process and again in the offer process, if you read it.

Lending Club on 12/5/14 to terminate her application. Due to an internal communication error, Lending Club did not withdraw Ms. [redacted]'s application, as she requested, and the application remained active in the system. Because the application remained active, Ms. [redacted] continued to receive correspondence from Lending Club pertaining to the application, including an Adverse Action notification on 12/22/14.
We understand Ms. [redacted]'s concern and we sincerely apologize for the confusion. Ms. [redacted] can rest assured that Lending Club did not perform a hard inquiry on her credit. While credit report information is reflected on the Adverse Action notice, that information was obtained by performing a soft credit inquiry. Soft credit inquiries have no negative effect on consumer FICO scores.

Because the application remained active, Ms. [redacted] continued to receive correspondence from Lending Club pertaining to the application, including an Adverse Action notification on 12/22/14.
The above comment is inaccurate as I did not receive any correspondence from them from the moment I withdrew my application until receiving my notice of not being approved. Also, their representive [redacted], said I was approved for $19,000 on the soft credit check... and lender always "pre-approve" on a soft check. To indicate they pre approved me from a soft check, and then disapproved me from a soft check makes no sense. As a tech person it is always easy for people to talk about internal communication errors. If that is indeed the case then they need to examine their process and make improvements. I notice they have a number of "closed" complaints and this indicates there is something wrong in the way they do business. They may have an A+ rating, but it really does not means much when they have the number of complaints they have.

At the time of loan application, Lending Club asks the applicant for other important information, such as the applicant's personal annual income and employment status. Because several weeks can pass [redacted] the pre-screening process and the actual application, we also request updated information from the credit bureaus. Both sets of information are used to determine if an applicant qualifies for a loan offer at that time.
Common reasons for being declined for a loan after receiving a pre-approved offer are that an applicant's current outstanding debt is too high relative to the applicant's personal annual income or that changes have occurred in the applicant's credit report since pre-screening. The specific reasons why Mr. [redacted]'s loan application was declined are provided in an adverse action notice, which can be viewed by logging into his Lending Club account summary.
Loans originated through the Lending Club platform are underwritten and made by WebBank, Salt Lake City, UT, member FDIC. Lending Club delivered the adverse action letter to Mr. [redacted] on behalf of WebBank.
At Lending Club, we are always open to [redacted] feedback, and we appreciate Mr. [redacted]'s suggestion for our marketing letter. The use of the word "pre-approved" describes the firm offer of credit we extended to Mr. [redacted] after the initial pre-screen process. As stated in the offer letter we sent to Mr. [redacted] and described above, the pre-approved offer is subject to reverification of an applicant's creditworthiness at the time the applicant applies for the loan.
Please note that the pre-screening process and loan application do not affect an applicant's credit score, because neither action is reported to credit bureaus as a hard credit inquiry. Mr. [redacted] is eligible to apply again for a loan via Lending Club in the future.
To ensure Mr. [redacted] does not receive any future unwanted contact from Lending Club, we removed his contact information from our email and direct mail marketing lists. My credit score has only been increasing since last year. My annual income is $89,000 and employment is full-time for 18 years with the same company. If anything had changed since they did the pre-approval, then it was my credit score was better (even though only a few points). This type of practice should not be tolerated. I just received a pre-approved credit card offer from Merrick bank (after Lendingclub) . When I applied, they approved me for exactly what they pre-approved me for the amount that they offered in the letter. This is unacceptable. I want at least a $1000 credit offer at a respectable APR to help re-establish my credit like they promised.

On 8/24/15, Ms. [redacted] contacted Lending Club advising she would be sending in a payoff check through a third party company. ...

Lending Club received a check on 8/31/15. The check was applied to her account on 8/31/15 and her loan status reflected as "fully paid" on 9/4/15. Because the payoff came from a third party, Lending Club submitted the refund check to that third party. The refund check was mailed on 9/29/15.
Lending Club apologizes for the delay in processing time.
A Lending Club representative spoke with Ms. [redacted] via phone on 10/1/15 to clarify the refund process and apologize for any confusion.

We are aware of the situation referred to in the complaint to the Revdex.com. The circumstances of the event to which Ms. [redacted]...

has fallen victim are not the result of any actions by Lending Club or its affiliates. We are sorry to report that Ms. [redacted] is a victim of an ongoing scheme where the Lending Club name or a variation of Lending Club is used to entice victims to pay up-front fees for non-existent loans, which is known as an Advanced Fee Scam.
It appears that after a victim has applied for a loan online through an unaffiliated website, the victim's loan request information is somehow obtained by the fraudsters. The fraudster then contacts the victim using the Lending Club name or a variation of Lending Club. They promise the victim that they can obtain a loan through Lending Club by paying an application fee. In some instances, the fraudsters return to the same victim multiple times requesting additional funds in exchange for securing a loan. Funds are usually transferred to the fraudsters through the use of a Green Dot or Vanilla Visa card (or similar device), companies with whom Lending Club has no relationship.
Furthermore, all loans through Lending Club are made without any application fee and are funded by WebBank, a Utah Industrial Bank. Information regarding the relationship between Lending Club and WebBank may be found on our website at lendingclub.com.
Regrettably, Ms. [redacted] is another victim of this fraud scheme. She is not a consumer who has engaged in any financial transactions with Lending Club. The people she spoke with were part of the fraud scheme.
The Lending Club Fraud Department spoke with Ms. [redacted] on 12/18/2015 and an email was sent on 12/17/2015 to explain the scam and these recommended next steps. Lending Club recommended that Ms. [redacted] add a fraud alert to her Credit Bureau report, file a complaint with the Internet Crime Complaint Center, and report the scam to her state's Attorney General.
Lending Club continues to work with consumers and any and all appropriate and willing law enforcement agencies to find and prosecute these fraudsters (FBI Complaint Id: IXXXXXXXXXXXXXXXX, FTC Complaint Id: XXXXXXXX). The United States Secret [redacted] (San Francisco chapter) met with Lending Club on 11/13/13 to discuss this issue and has since launched their investigation.

Mr. [redacted]'s December payment amount included a late fee which was assessed due to a late payment in the prior month. ...

After researching our records, we understand there was some confusion regarding the earlier payment, so Lending Club has refunded the late fee. To the extent that the late fee caused overdrafts in Mr. [redacted]'s bank account, Lending Club will also return those fees provided the borrower can substantiate them with documentation.
As for the date of the December payment, Lending Club records indicate the funds for Mr. [redacted]'s December monthly payment were received on 12/21/2015. Lending Club notifies financial institutions of the upcoming transaction the business day prior to the payment due date. As a result, some financial institutions may list the transaction as "pending" on a consumer's bank account. Lending Club recommends that Mr. [redacted] contact his financial institution to learn more about how pending transactions affect his account.

Thank you for giving us the opportunity to respond to [redacted]'s Revdex.com complaint. We would like to clarify the loan withdrawal process.
An applicant may cancel their request for a loan through Lending Club any...

time before the loan is issued by contacting Lending Club and requesting to do so. We make every effort to process these requests in a timely manner. Once a loan has issued, Lending Club is unable to withdraw it and borrowers will be responsible for repaying the loan, fees, and interest.
Mr. [redacted] followed the withdrawal procedure, and Lending Club apologizes for not processing his withdrawal request in a timely manner. Lending Club has been in contact with Mr. [redacted] to address his concerns. We have processed the cancellation of the loan, and Mr. [redacted] is not responsible for the loan principal or interest. Further, he will not incur any penalties or fees for this loan withdrawal. Finally, Lending Club will ensure that this loan is not reflected on Mr. [redacted]'s credit report.
