I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
First of all, the company's response is absurd in a variety of ways. Whether they've been in business for 35 years or 5 years is of no consequence or relevance as to whether or not they did or did not damage the vehicle. Second, the vacuum hose from the transfer casing that was cut would never leak oil- it simply provides a release of pressure- therefore it would not have leaked oil, nor any other fluid (any car company in business for 35 years would know this). Third, whether or not the vehicle had expired tags or not, again, has no consequence or relevance as to whether their company damaged the vehicle. It's simply an attempt to distract from the true facts and matter at hand, and to try to defamate me. The next point they try to make, in which they state it appears the vehicle had not been driven in a long time is just absurd. Our neighbors, including the Indiana State Police officer across the street (witnesses), can testify that the vehicle was used on a daily basis. It also had our children's car seats in it, it had a $400 stereo system installed in it, and other recent receipts fom gasoline purchases made within the last month and weeks.Had the vehicle been abandoned or not driven in a very long time, we clearly would not have these items in the vehicle. Additionally, we have pictures in which we drove the vehicle, with 7 people inside (witnesses), to Brown County and back the very day before they repossessed it, and the vehicle did not show any signs of a broken sway bar.. As far as the company stating they placed the vehicle on a dolly to transport it, it still requires that the vehicle is moved and/ or lifted in order to place the vhicle on the dolly. Considering the State Trooper parks in the street immediately in front of our driveway, I find it hard and almost possible to believe this was a routine and easy task, given the length of the Ford Explorer plus the length of the tow vehicle. Simple physics would explain that it is not only possible, but quite likely that a large amount of torque and uneven distribution of weight would occur in trying to accomplish dragging the vehicle to provide enough room to place on the dolly, and that the act of lifting the vehicle to place on the dolly, would be enough to place enough torque and pressure to the right front sway bar to snap it in half. We also have a mechanic who looked at the damage, and agreed with the assessment that this must have occurred during thr repossession/ towing process. Additionally, the vehicle was not undriveable, but was immediately clear that the vehicle was driving in a manner that it had not been experiencing before the repossession. We managed to drive the vehicle home slowly, and thankfully, only a short distance from Lenders Recovery, although it was very unsafe to drive.

The vehicle was repossessed by us but no damage was done by our company.  As to the first allegation we have been in business 35 years and never have, or never will,  cut any line on any car that could jeopardize the safety of any person.  In addition the vehicle sat in our building...

overnight and there was not a sign of any oil leak that would have been visible had we cut the mentioned line.This vehicle (due to the type) was dollied, no chains, no hooks.  Nothing hooked underneath to cause damage.  Had a sway bar been snapped the vehicle would not have even been driveable out of our garage.  It was with no issues by the customer.In addition the vehicle is in poor condition, has over 150,000 miles on it.   It was located sitting and did not appear to have been driven for a long time.  If it had been driven it was ILLEGALLY as the plate on the vehicle [redacted] expired 6 14 13, over 1 year ago.  Again, we do not think the vehicle was even being driven and they are trying to get us a previously damaged and worn out vehicle.Thank you for your assistance.

We stand by our statement that we did no damage. The vehicle was towed with dollies on one end and a wheel lift cradle on the other.  No attachment at all to under carriage parts.  No idea how any line was or could have been cut.  In addition we have 2 signed releases from the customer, one for all personal property and one for the vehicles release and it's condition.In our business we have zero happy customers but strive to make it as pleasent as possible.   The lengthy complaint aimed mainly at and my business reputation and knowledge of my job is not appreciated.  I would welcome the chance  to speak to her state police officer witness who observed her driving for over a year on expired plates.To be done with this and admitting no fault I will pay the customer 100.00.  Be advised this is my only offer and the final response to this allegation.
