This application was taken based on information gathered in a conversation with Mrs[redacted] As with every application that proceeds additional documentation maybe required Her pre-approval was given based on information she gave to the originator, Mr [redacted] Per the pre-approval letter it noted additional documentation maybe required and underwriting needed to review the file When underwriting reviewed the file and bankruptcy papers it was determined that the property she filed bankruptcy on was reaffirmed; so she was still responsible for it Since she was responsible for it and the credit report didn't show the current payment history (it only shows up to 2012) a verification of payment history was requested by underwriting The result of this verification was that there had been recent late payments, which made the loan to not be approved and therefore a denial was sent The information used to make this decision was not provided and gathered until underwriting of the loan had started In addition a current mortgage statement was provided showing her name on the statement, further proving she was aware of her responsibility of this mortgage Finally Mrs [redacted] filled out the declarations on her incorrectly, stating that she did not own any residential property; which was also inaccurate. It is an unfortunate situation but Lend Smart Mortgage and Scott [redacted] did everything they could to get her loan application approved based on the information she provided

Initial Business Response /* (1000, 8, 2015/09/15) */
The basis of this complaint is that the borrower's loan was denied after receiving complaints from a third party involved with the transaction. One has to stop and think how almost impossible this is in a 100% commission business. To think...

that after working on a loan for months, investing dozens of man hours in the process, dealing with multiple parties and vendors, and overcoming hurdles; that anyone would purposely deny a loan because of how they were talked to on the phone is crazy. Why would we invest all of that time and then not get paid for it if we could? The originator and the company only get paid when we close loans. We deal with aggressive Real Estate Agents all the time. If we chose to not close loans every time someone got upset we would not be in business very long.
The reality is that the borrower had a difficult file for multiple reasons. After overcoming multiple hurdles, the borrower needed an updated credit report to be pulled. When that report was pulled, it showed new late payments that were not part of the original underwrite. These new late payments were the reason for the denial. Credit was now unacceptable. The denial had absolutely nothing to do with anything else.
We could not remove the credit pulls from the bureau's if we wanted to. The credit was pulled to apply for a loan and this can't be removed.
Initial Consumer Rebuttal /* (3000, 10, 2015/09/16) */
(The consumer indicated he/she DID NOT accept the response from the business.)
The late payments we NOT in the underwrite. Also, found out that one payment was processed late. And very hard to believe that the denial was because of that report when back on June 22nd when that credit check was done, a conference call was made to the banker of those loans, as well as a letter of explanation was sent and that the second review after that came in as "ok" according to John [redacted]'s email sent to Candy [redacted], the realtor we were using. Question: Why did Lendsmart not deny the loan AT THAT TIME?? But let us continue for TWO WEEKS to finish getting homeowners insurance and transcripts from the IRS. Also, I have contacted 2 people I know that were/are in the mortgage business and they find it fishy that the denial was 100% denied due to the lates after not being late for 2 years on anything. A lot of time and energy was not only put on Lendsmart but on us too.. Wages were lost due to all this. No need to respond to this.. I will be filing a complaint with the Attorney General of MN and talking to a personal Attorney.

This application was taken based on information gathered in a conversation with Mrs.[redacted].  As with every application that proceeds additional documentation maybe required.  Her pre-approval was given based on information she gave to the originator, Mr. [redacted].  Per the pre-approval letter it noted additional documentation maybe required and underwriting needed to review the file.  When underwriting reviewed the file and bankruptcy papers it was determined that the property she filed bankruptcy on was reaffirmed; so she was still responsible for it.  Since she was responsible for it and the credit report didn't show the current payment history (it only shows up to 2012) a verification of payment history was requested by underwriting.  The result of this verification was that there had been recent late payments, which made the loan to not be approved and therefore a denial was sent.  The information used to make this decision was not provided and gathered until underwriting of the loan had started.  In addition a current mortgage statement was provided showing her name on the statement, further proving she was aware of her responsibility of this mortgage.  Finally Mrs. [redacted] filled out the declarations on her 1003 incorrectly, stating that she did not own any residential property; which was also inaccurate. It is an unfortunate situation but Lend Smart Mortgage and Scott [redacted] did everything they could to get her loan application approved based on the information she provided.

I am rejecting this response because: This company apparently has an issue with ethics. I never completed the form indicated. I attempted to go print the full application and was unable to now the documents no longer available. I only signed and dated forms sent to me via the portal they were already filled in. How could I lie that I never had a mortgage when all 3 of my credit reports shows Wells Fargo Home Mortgage and it shows included in bankruptcy. Scott got those reports before anything was done and they have those documents. I don't understand why this person is lying about it. They can present them to the next agency this is escalated to. I still say on the payment history from Wells Fargo it does not reflect any charges LATE CHARGES OR FEES. So this mortgage was reaffirmed, and Wells Fargo accepts those payments monthly yet it shows no LATE FEES so did they say my payments were late or the underwriter. Mortgage shows payments made after the 1st yet still there are no LATE FEES. The delinquent credit history is what I have issues with this information that he had from day one.  This was a waste of my money and time. Again this company has an ethics issue as well.
