*** did contact me to secure a rental of my timeshare in New Orleans and due to circumstances beyond my control,
I was unable to provide there with the units she had originally requested
Per our agreement,
Unavailability of the Unit
o in the unlikely possibility of the unit being unavailable or unusable when you arrive for cheor at any time during your occupancy, (due to such circumstances as damage to the property, emergency repairs, or error by the resort in booking reservations), my liability is limited to the amount you paid for the reservations
o You and I agree the provisions of this section will be the sole extent of my liability associated with the unavailability of this unit
I have always stated that I will refund the complete partial payment per the agreement
If this is the extent of her demand with no further demands here or in any other venue, then I will return the $down payment that was made
