L.D. & Son/Marca Fence

I have a written contract dated 7/26/16 with Jerry Dipasquale owner of Marca fence to fence my son’s yard. I paid $4400, half as a deposit 8/4/16 to Jerry Dipasquale. He wrote on the contract he’d start the fence in 3 weeks. He never started the fence. After multiple excuses By Mr Dipasquale for the failure to build the fence I requested a return of my $4400. It has taken countless phone calls and a certified letter to Mr Dipasquale to pay me in small $100 increments which he agreed to, until the $4400 was paid off.
He has failed to complete the payments and still owes me $400.
He is not returning my calls.
I plan to pursue this debt by filing a police report and then in small claims court. I have copies of the contract, my cashed check, certified letter, and money orders showing all payments made to date, along with a ledger showing all contacts and responses.
I demand my $400 immediately.

Review: I signed a contract with the business owner [redacted] in May 2014 to install our backyard fence and gave him a 30% deposit ($3,100) at that time. The contract states that he would start work on the fence the week of June 2, 2014. They still have not started the work as of October 23. I have called [redacted] 2 - 3 times a week over the past few months and when he does return my calls, he gives many excuses for the delay and says he will get the fence done "next week for sure", but never shows up. Earlier this month, he offered to take 5% off the cost due to the delay which I accepted, provided he complete the job right away. I have demanded my deposit back but he insists he is going to do the work and has not returned the money.Desired Settlement: Refund of my deposit or completion of the work immediately.

Review: We had a contract to have a fence installed on 6/2/14. We gave a deposit of $2560. They never showed up to do the work. As of August, I gave up and contacted them for a refund. They refunded $1500 of my money but still owe me $1060. I have called several times since October. I have received return calls with the promise of money but have not received a dime since September. I want my money back.Desired Settlement: I want a money order for the final $1060 that I am owed.

Review: Myself and my neighbor contracted with MARCA fence, owned by [redacted], for a vinyl residential fence. Both parties paid a significant deposit. Marca fence failed to show up to install a fence. After numerous calls, we received excuse and excuse. Now [redacted] is not returning any of our calls or written requests nor will he return to deposits of both parties. We will proceed to small clains court if he does not return our money.Desired Settlement: Return deposits of both [redacted] families
